3.Properties in the area are primarily developed with single family dwellings and zoned RS. <br />4.When these two undeveloped properties were created (Urban Partitioning Case #00-2), <br />research indicated that a 60 foot unopened, unimproved right-of-way along the eastern <br />boundary [30 feet of which was on the subject property] had been vacated in 1980. <br />Access to these two parcels was via a 20 foot private drive named Jamie Lane. <br />Subsequent to the road vacation in 1980, however, property owners granted the Marion <br />Department of Public Works a 30 foot easement for road purposes along the eastern <br />boundary of the original property. This fact was not discovered until the partitioning plat <br />was filed and the applicant tried to apply for building permits. With the additional 10 feet <br />of easement, any residences placed on these two parcels unfortunately cannot meet all <br />setback requirements of the RS zone. As a result, the applicant is requesting to reduce the <br />14 foot rear yard setback to 6 feet on these two properties. <br />5.The Marion County Department of Public Works reviewed the proposal and had the <br />following comments: <br />“Public Work’s comments for Partition 00-2 shall still apply for this adjust- <br />ment application. <br />Also, prior to building permits being issued, the applicant shall submit a site <br />drainage plan that includes existing contours and how the applicant pro- <br />poses to discharge roof runoff from the site. <br />Construction of improvements on the property shall not block historical or <br />naturally occurring runoff from adjacent properties.” <br />Marion County Fire District #1 stated all development must comply with the following: <br />“Approved fire hydrant and water supply requirements per Oregon Uni- <br />form Fire Code. <br />Address requirements for residential use per Oregon Uniform Fire Code. <br />Fire apparatus access roads on private property per Oregon Uniform Fire <br />Code.” <br />All other responding agencies indicated they are not affected by the proposal. <br />6.The decision criteria for a major adjustment are found in Section 41.04 of the Marion <br />County Urban Zoning Ordinance. They include: <br />(a)The degree of adjustment from the standard is the minimum necessary to permit <br />development of the property for the proposed use; and <br /> <br />
