(c)The adjustment will not have a significant adverse affect upon the health or safety <br />of persons working or residing in the vicinity; and, <br />(d)The adjustment will maintain the intent and purpose of the provision being ad- <br />justed. <br />8.The property was created as a residential lot to accommodate one dwelling unit. As <br />previously mentioned, the parcel contains an existing dwelling, and the applicant wishes to <br />construct an attached garage on the property, however, the setbacks of the RS zone limits <br />the area you can develop. A site plan submitted with the application demonstrates the <br />requested adjustment is necessary to develop the property for its intended use. The <br />proposal meets 7 (a). <br />9.The RS zone requires a 12 foot setback from any front property line or lot line abutting a <br />street or roadway. However garages or carports having a vehicle entrance facing a street <br />or roadway right-of-way shall be set back at least 20 feet. This proposal is to allow <br />placement of an attached garage within 12 feet of the front property line along Bass Lane <br />instead of the required 20 feet. <br />10.Access to the property will be from Bass Lane, and the proposed garage will set back 12 <br />feet from street right-of-way which is a 20 foot private easement that serves one other <br />parcel. The RS (SINGLE FAMILY RESIDENTIAL) zone allows a 12 foot front yard <br />setback for a single family dwelling. The existing dwelling currently is placed at 12 feet <br />from the lot line, and the attached garage will maintain an alignment with the existing <br />dwelling. Considering the limited number of vehicles using the access, reducing the <br />setback along Bass Lane to 12 feet should have no adverse affects on neighboring <br />properties or the health and safety of persons residing in the area and is consistent with <br />other developments within the RS zone. In addition, staff contacts with Marion County <br />Department of Public Works, Marion County Fire District #1, and other agencies indi- <br />cated that the notified agencies stated no concerns with this request. The proposal <br />satisfies the criteria in 7(b), (c), and (d). <br />11.The granting of this major adjustment maintains the intent of the Marion County Urban <br />Zoning Ordinance and the Marion County Comprehensive Plan. Therefore, the proposed <br />major adjustment to reduce the setback along both Bass Lane is approved. <br />Craig O.
