This decision is effective unless further <br />consideration is requested. <br />FINDINGS AND CONCLUSIONS: <br /> The findings and conclusions on which the Zoning <br />Administrator based the decision are noted below. <br />1.The subject property lies within the Salem/Keizer Urban Growth Boundary and is <br />designated Single Family Residential in the Salem Area Comprehensive Plan (SACP). The <br />parcels RS (SINGLE FAMILY RESIDENTIAL) zoning is under the jurisdiction of <br />Marion County. The purpose of both the Plan designation and zoning is to provide for <br />residential development at low urban densities. <br />2.The parcel is located on the south side of Bass Lane which is a private access easement <br />that extends 150 feet west from Elma Avenue SE. <br />3.Properties surrounding the subject parcel are zoned RS and in single family residential <br />development. <br />4. The subject parcel contains an existing dwelling. The property was created in 1999 as a <br />result of Partitioning Case #99-3 (P99-3) and is identified as parcel 2 of Plat #99-107. <br />5.All contacted agencies either failed to respond or stated no objection to the proposal at the <br />time this report was written. <br />6.Because this proposal expands a quantifiable Ordinance standard by more than 20%, this <br />request is classified as a Major Adjustment. <br />7.The decision criteria for a major adjustment are found in Section 41.04. These criteria <br />include: <br />(a)The degree of adjustment from the standard is the minimum necessary to permit <br />development of the property for the proposed use; and <br />(b)The adjustment will not have a significant adverse affect on property or improve- <br />ments of the neighborhood of the subject property; and <br /> <br />
