<1. Discretionary Distributions. Until the beneficiary is twenty-five (25), my Trustee <br /> shall pay to or for the benefit of the beneficiary such portions of the income and principal of the <br /> trust as my Trustee may determine to he necessary for his or her health, maintenance, support <br /> and education. In making discretionary distributions, my Trustee may, but shall not be required <br /> to, determine other sources of income, support or property available to the beneficiary, and my <br /> Trustee shall have absolute discretion to determine the extent to which such other income, <br /> support or property must first be utilized by the beneficiary. <br /> B. Distribution of Separate Trust. When the beneficiary is twenty-five (25), the <br /> remaining property of the trust shall be distributed to the beneficiary, and the trust shall <br /> terminate. <br /> C. General Power of Appointment. If the beneficiary dies prior to receiving <br /> distribution in full of the trust, the remaining property of the trust shall be distributed as the <br /> beneficiary may appoint by his or her last will, with specific reference to the power herein given, <br /> which power may be exercised in favor of the beneficiary's estate or the creditors of the <br /> beneficiary's estate. <br /> D. Failure to Exercise Power. If the beneficiary dies prior to receiving distribution <br /> of the trust, not having exercised the general power of appointment or having exercised it only <br /> partially, all the property as to which such power is not exercised shall be distributed in equal <br /> shares to the surviving children of the beneficiary, or if none, in equal shares to the surviving <br /> brothers and sisters of the beneficiary, or if none, to my then surviving lineal descendants, who <br /> shall take by right of representation. If any such descendant is a beneficiary of a separate trust <br /> established by this instrument, the share of such descendant shall be added to the trust and <br /> administered and distributed as a part thereof. <br /> ARTICLE XIII. <br /> TRUSTEE PROVISIONS <br /> A. Resignation of Trustee. A Trustee may resign at any time without court approval <br /> by giving written notice to the successor Trustee, or if there is no successor, to the beneficiaries, <br /> rttctnriv of minnr henefiriAries <br /> B. Appointment of Successor Trustee. If there shall be no Trustee of a trust, a <br /> majority in interest of those income beneficiaries who are of legal age and capacity and the <br /> Guardians, if any, of those who are not of legal age and capacity may by a written instrument <br /> appoint a successor Trustee or Trustees. <br /> C. Responsibility of Successor. A successor Trustee shall have the same rights, <br /> titles, powers, duties, discretions and immunities and otherwise be in the same position as if the <br /> successor Trustee had been originally named as Trustee hereunder. No successor Trustee shall <br /> be personally liable for any act or failure to act of any predecessor Trustee or shall have any duty <br /> to examine the records of any predecessor Trustee.
