Marion County
OREGON
PUBLIC WORKS
June 27, 2022
(503)588-5036
BOARD OF
COMMISSIONERS Randy Jacobsen
Danielle Bethell 151 Wildflower Ln
Colm Willis Silverton OR 97381
Kevin Cameron
DIRECTOR RE: Authorization 555-22-005329 for connection of replacement dwellingto the
P
Brian Nicholas, P.E. existing septic system at 24023 Patton Loop SE, Lyons, Oregon.
ADMINISTRATION Dear Mr. Jacobsen,
BUILDING
INSPECTION You submitted an application for an authorization inspection and proposed
connection of a replacement dwelling to the existing home. A site visit was made
EMERGENCY on June 21, 2022, and identified the following:
MANAGEMENT
ENGINEERING 1. According to Ace Septic, the system consists of a 1,000-gallon septic tank
and 200 feet of drainfield. Marion County has records of the original system
ENVIRONMENTAL installation from 1979. Based upon the information provided by the owner, the
SERVICES current system was installed approximatelyten years ago without permits(Marion
OPERATIONS County has no records of the system replacement).
2. A system may only be placed into service if the following criteria can be
PARKS met according to OAR 340-71-0205(4):
a. The existing system is not failing — No system failure was observed on
PLANNING June 21, 2022, by Marion County.
SURVEY b. All setbacks between the existing system and the structure can be
maintained—This has been waived by the Governor's Executive Order
20-60.
c. In the agent's opinion, the proposed use would not create a public
health hazard on the ground surface or in the public surface waters—
This is not currently met—see below.
Little is known of the construction of the existing system, particularly the existing •
drainfield, such as the depth of the lines, materials used, and whether the lines
were installed level. The tank was on a watertight test and was found to be
installed level on June 21, 2022. OAR 340-071-0185(1)(d) requires a system to be
decommissioned if it was installed without a permit, as this system was. In order
to potentially bring the system into compliance, the following steps are required:
5155 Silverton Road NE•Salem,OR 97305-3802• www.co.marion.or.us/PW
Printed on recycled paper• Reduce—Reuse—Recycle-Recover
