` <br />- <br />- <br />NOTICE OF DECISION <br />LOT LINE ADJUSTMENT CASE NO. B6-31 <br />APPLICATION: Application of Paul and Evelyn Barham and the <br />('tate of Russell Proudfit (Evelyn Barham, Administrator) to <br />adjust the property lot lines on a 0.22 acre parcel and a 2.17 <br />acre parcel to create a 0.30 acre parcel and a 2.09 acre parcel <br />in an RA (RESIDENTIAL AGRICULTURAL) zone on property located at <br />3055 and 3075 Hollywood Drive NE (Sec. 18; T7S; R2W). Tax lot <br />#82475-270 and 82475-260. <br />DECISION: Notice is hereby given that the Planning Director for <br />Marion County has APPROVED the above described Lot Line Adjust- <br />ment application subject to certain conditions. <br />CONCLUSIONS:FINDINGS AND The findings and conclusions on which <br />the Director based his decision are noted below. <br />Conditions of approval. <br />1. Title transfer instruments accomplishing the property <br />adjustments shall be recorded with the Marion County Clerk <br />by ^ <br />' <br />The lot line adjustment shall comply with all requirements <br />of the Marion County Building Inspection Division. Prior to <br />"--' <br />�Z preparing the transfer instrument, the applicant shall check <br />with the Marion County Building Inspection Division and the <br />Planning Division to ensure that the adjusted property lines <br />- <br />are not located too close to a structure or septic drain- <br />~--- �� <br />�Z field. <br />��-- CD <br />-�c <br />Those portions of Parcel #2 added to Parcel #1 shall be <br />--' <br />placed in the same named ownership as Parcel #1. The <br />expanded parcel shall be considered one parcel for land use <br />----- <br />-- purposes. <br />PROCEDURE: The Marion County Subdivision and Partitioning <br />Ordinance provides that certain Lot Line Adjustment applications <br />be considered first by the County Planning Director. If there is <br />any doubt that the application conforms with adopted land use <br />policies and regulations the Director must condition or deny the <br />application. Any interested person who disagrees with the <br />Director's decision may request that the application be consid- <br />ered by the Marion County Hearings Officer after a public <br />hearing. The applicant may also request reconsideration on the <br />basis of new information subject to signing a waiver of the 120 <br />day time limit for review of zoning applications. A public <br />hearing is held on appeals subject to the appellant paying a <br />$25.00 fee.
