If you have questions, contact the staff person listed <br />at the end of this report. <br /> <br />NOTICE OF DECISION <br />CONDITIONAL USE CASE NO. 26-017 <br /> <br />APPLICATION: Application of Aaron and Maranda Fouts for a conditional use permit to operate an automotive repair <br />business as a home occupation on a 2.62-acre parcel in an AR (Acreage Residential) zone located at 2363 82nd Ave SE, <br />Salem (T8S; R2W; Section 2A; Tax lot 1400). <br /> <br />DECISION: The Planning Director for Marion County has APPROVED the above-described Conditional Use applica- <br />tion subject to certain conditions. <br /> <br />EXPIRATION DATE: This Conditional Use Permit is valid only when exercised by July 6th, 2028. The effective <br />period may be extended for an additional year subject to approval of an extension (form available from the Planning <br />Division). Additional extensions may not be granted if the regulations under which this decision was granted have <br />changed since the original approval. <br /> <br />RENEWAL: This permit may be renewed for successive one-year periods if the applicant submits to the Planning <br />Division, on an annual basis, a new Physician's Certificate which indicates that the hardship continues to exist. <br /> <br />WARNING: A decision approving the proposed use is for land use purposes only. Due to septic, well, and drain field <br />replacement areas, this parcel may not be able to support the proposed use. To ensure the subject property can <br />accommodate the proposed use the applicant should contact the Building Inspection Division, (503) 588-5147. <br /> <br />This decision does not include approval of a building permit. <br /> <br />CONDITIONS: The following conditions must be met before a building permit can be obtained or the approved use <br />established: <br /> <br />1. The applicant shall obtain approval for all required permits from the Marion County Building Inspection Division. <br />(Please see the comments provided by Marion County Building under Finding #5) <br /> <br />2. Per Marion County Septic; An authorization is required due to the change of use/proposed home occupation and <br />shall be obtained prior to operating the proposed home occupation. See Finding #5 for comments relating to <br />required information for the authorization. <br /> <br />3. The accessory structures proposed for use in the home occupation shall be retrofitted with insulation for noise <br />absorption prior to starting automotive repair services. <br /> <br />4. Dedicated fluid and waste material storage areas shall be in place prior to starting automotive repair services. <br />These storage areas shall meet all relevant industry and regulatory standards from agencies such as the <br />Department of Environmental Quality or Environmental Protection Agency. <br /> <br />5. The applicant shall submit a procedure for containing and cleaning spills to the planning department prior to <br />conducting automotive repair services. <br /> <br />ADDITIONAL CONDITIONS: Once the approved use is established the following conditions must be continually <br />satisfied: <br /> <br />6. The proposed home occupation shall continuously operate in compliance with the use and development standards <br />for conditional home occupations outlined under MCC 17.120.075 (these standards are outlined under Finding #6 <br />below). <br /> <br />7. The automotive repair home occupation shall operate in compliance with all operational standards required by <br />local, state, and federal regulatory agencies such as, but not limited to, Oregon Department of Environmental <br />Quality. <br /> <br />8. Any signs erected relating to the business shall meet the standards in Chapter 17.191 MCC.
