BEFORE THE BOARD OF COMMISSIONERS <br />FOR MARION COUNTY, ORE, GON <br />In the Matter of the ) Case No. CU24-028 <br />Application of: ) <br />Marvin Klopfenstein ) <br />ORDER NO. aS 13 b <br />This matter comes before the Marion County Board of Commissioners ("Board") on the <br />application of Marvin Klopfenstein for a conditional use permit to operate a mulching service as a <br />commercial activity in conjunction with farm use on a 9.72-acre parcel in an EFU (Exclusive Farm <br />Use) zone located at 5711 Brooklake Rd. NE, Salem (T6S; R2W; Section 16; Tax lot 2100). <br />The Marion County Hearings Officer held a duly noticed public hearing on this application on <br />January 30, 2025, and issued a decision denying the proposal on March 28, 2025. The Hearings <br />Officer's decision was appealed to the Board on April 9, 2025. On July 23, 2025, the Board <br />considered the appeal, application, record, and findings. <br />IT IS HEREBY ORDERED that the Board DENIES Conditional Use Application 24-028 and <br />adopts the findings contained in Exhibit A, attached. <br />DATED this r �yday of e r , 2025, at Salem, Oregon. <br />[COUNTY F COMMISSIONERS <br />Commissioner <br />Commissioner <br />JUDICIAL NOTICE <br />Oregon Revised Statutes, Chapter 197.830, provides that land use decisions may be reviewed by <br />the Land Use Board of Appeals by filing a notice of intent to appeal within 21 days from the date <br />this Ordinance becomes final. <br />
