The <br />decision in this case does not directly affect the zoning or use of your property. If you object to the decision, refer <br />to the "Appeal" section. If you have questions, contact the staff person listed at the end of this report. <br /> <br />NOTICE OF DECISION <br />FLOODPLAIN DEVELOPMENT PERMIT CASE NO. 11-009 <br /> <br />APPLICATION: <br /> Application of Danny, Linda, and Eric Trefethen for a floodplain development permit to place an <br />accessory structure in the identified 100 year floodplain of the North Santiam River on a 1.6 acre parcel in an EFU <br />(Exclusive Farm Use) zone located at 16532 Greens Bridge Road SE, Jefferson. (T10S; R2W; Section 8; tax lot 600). <br /> <br />DECISIONAPPROVED <br />: The Planning Director for Marion County has the above-described Floodplain Development <br />application subject to certain conditions. <br /> <br />EXPIRATION DATE <br />: This Floodplain Development Permit is valid only when exercised by JANUARY 5, 2014. The <br />effective period may be extended for an additional year subject to approval of an extension (form available from the <br />Additional extensions may not be granted if the regulations under which this decision was <br />Planning Division). <br />granted have changed since the original approval. <br /> <br /> <br />WARNING: <br />A decision approving the proposed use is for land use purposes only. Due to septic, well, and drain field <br />replacement areas, these parcels may not be able to support the proposed use. To be sure the subject property can <br />accommodate the proposed use the applicant should contact the Building Inspection Division, (503) 588-5147. <br /> <br />This decision does not include approval of a building permit. <br /> <br /> <br />CONDITIONS: <br /> The following conditions must be met before a building permit can be obtained or the approved use es- <br />tablished: <br /> <br />1. The applicant shall obtain all necessary building permits from the Marion County Building Inspection Division. <br /> <br />2. An Elevation Certificate shall be supplied at the following times: <br /> <br /> a. Once the floor elevation can be determined (based on the building under construction), and <br /> b. Prior to occupancy (based on finished construction). <br /> <br />3. Prior to issuance of building permits, a registered civil engineer shall certify the proposal meets the requirements <br />of Section 17.178.050(D) of the Marion County Code (MCC). <br /> <br />4. Prior to issuance of building permits, a registered civil engineer or architect shall certify the proposal meets the <br />requirements of MCC 17.178.060(A)(8). <br /> <br />5. Prior to issuance of building permits, a registered civil engineer or architect shall certify the proposal meets the <br />requirements of MCC 17.178.060(D)(1), (E) and (F). <br /> <br />6. If the structure is constructed to the wet floodproofing standards in 17.178.060(A)(8), the property owner shall, <br />prior to issuance of the permit, sign and record in the deed records for the county a declaratory statement binding <br />the landowner, and the landowner’s successors in interest acknowledging the non-conversion agreement, as <br />complies with MCC 17.178.060 (A)(8)(B). The applicant shall record the declaratory statement with the Marion <br />County Clerk after it has been reviewed and signed by the Planning Director. (Declaratory Statement enclosed). <br /> <br />7. The location of the new building shall significantly conform to the site plan submitted with the proposal. Minor <br />variations are permitted upon review and approval of the Planning Director. <br /> <br /> <br />
