<br />NOTICE OF DECISION <br />ADMINISTRATIVE REVIEW CASE NO. 00-10 <br />APPLICATION: <br />Application of Joseph & Cherie Eder, Raymond & <br />Patricia Eder, and Duane & Debora Eder for an administrative review <br />to replace an existing dwelling on a 55.83 acre parcel in an EFU <br />(EXCLUSIVE FARM USE) zone located at 11407 Portland Road NE, <br />Gervais. (Section 3; T6S; R2W) Lot 200. <br />DECISION: <br /> Notice is hereby given that the Planning Director for <br />Marion County has determined that the existing residence is a <br />legally established dwelling that can be altered, restored or <br />replaced. <br />MARCH <br /> <br />EXPIRATION: <br /> This decision is valid only when exercised by <br />14, 2002 <br /> (two years from the effective date of the decision) <br />unless an extension is granted. The effective period of this <br />application may be extended for one year subject to approval of an <br />extension. Request for an extension must be submitted to the <br />Planning Division prior to expiration of the approval. (Extension <br />form available from the Planning Division). <br />CONDITIONS: <br /> <br />1.The applicants shall obtain all permits, including subsurface <br />sewage disposal, required by the Marion County Building <br />Inspection Division. <br />2.If replaced, the existing dwelling must be removed, demol- <br />ished, or converted to an allowable non-residential use within <br />three months of occupancy of the replacement dwelling. <br />3.Prior to obtaining any building permit, the applicant shall <br />sign and submit a Declaratory Statement to the Planning <br />Division. This statement shall be recorded by the applicant <br />with the Marion County Clerk after it has been reviewed and <br />signed by the Planning Director (Declaratory Statement <br />enclosed). <br />Other Permits, Fees and Restrictions: <br />The applicants are advised that the use of the property proposed in <br />this application may require additional permits and/or fees from <br />other local, State or Federal agencies. The Marion County land use <br />review and approval process does not take the place of, or relieve <br />the applicants of responsibility for acquiring such other permits, <br /> <br />
