There. is no evidence the sign placed so that it would <br />not block vision clearance in the intersection area, <br />would be detrimental to the public welfare or persons or <br />property in the area. <br />6. The substantial property rights, of the petitioner go to <br />the primary use of the subject property which is resi- <br />dential. Therefore, a variance of the sign requirement <br />,is not necessary for preservation and enjoyment of these <br />rights. <br />The applicant has failed to meet th'e burden of proof to <br />vary the size requirements of the permitted sign under <br />MCZO 191.030(h). <br />VI. Order <br />It is herebv found that the applicants' have failed to meet <br />the burden of proving the relevant standards and criteria for a <br />variance to the sign 'size requirements of the Zoning Ordinance, <br />and therefore, it is ordered that the request for a Variance be <br />DENIED. <br />It is further found that applicants have met the burden of <br />proving the relevant standards and criteria for a conditional use <br />home -occupation, and therefore, a Conditional Use permit is <br />hereby GRANTED, subject to the following conditions: <br />1. The applicant shall obtain all permits required by the <br />Marion County Building Inspection Division. <br />2. The applicant shall comply with all requirements of the <br />Uniform Fire Code as requested by Marion County Fire <br />District #1. <br />3. The conditional use permit approved herein is valid for <br />a period of one year from the effective date of this <br />Order, unless a request for extension is made in writing <br />to the Planning Division prior to the expiration of the <br />permit. <br />4. The use shall be -limited to one sign, one square foot in <br />size. <br />5.
