If storage building is not existing, then <br />permits are required." <br />The County Assessor noted that the property is being as- <br />sessed at Farm Value. <br />2.The general criteria relevant to this application are found <br />in Marion County Rural Zoning Ordinance Section 119.070. <br />These criteria are outlined below: <br />(a)That the Hearings Officer has the power to grant the <br />conditional use; <br />(b)That such conditional use, as described by the appli- <br />cant, shall be harmony with the purpose and intent of <br />the zone; <br />(c)That any condition imposed is necessary for the public <br />health, safety or welfare, or to protect the health or <br />safety of persons working or residing in the area, or <br />the protection of property or improvements in the area. <br />3.Section 119.030 grants the Hearings Officer the authority to <br />grant approval for those conditional uses in the Ordinance. <br />Section 136.030(z) of the EFU zone allows "the breeding, <br />boarding and training of horses not owned by the property <br />owner or resident, for profit, including horse shows, compe- <br />titions, clinics, demonstrations and riding lessons" as a <br />conditional use provided the proposal complies with the <br />criteria contained in Section 136.040(d). <br />4.The decision criteria set forth in Section 136.040(d) in- <br />cludes the following: <br />(a)The use will not force a significant change in, or <br />significantly increase the cost of, accepted farm or <br />forest practices on surrounding lands devoted to farm <br />or forest use; <br />(b)Adequate fire protection and other rural services are <br />available, or will be available when the use is estab- <br />lished; <br />(c)The use will not have a significant adverse impact on <br />watershed, groundwater, fish and wildlife habitat, soil <br />and slope stability, air and water quality; and <br />(d)Any noise associated with the use will not have a <br />significant adverse impact on nearby land uses. <br /> <br />
