Maureen Callahan VanderMay
Attorney and Counselor at Law
547 Court Street Northeast
Salem, Oregon 97301
(503) 588-8053 FAX (503) 588-3624
April 4, 1997
Mr. Dan Berrey
Courthouse Square
340 Vista Avenue S.E.
Salem, OR 97302
Re: VanderMav & Dovle Relocation Benefit Application
Dear Mr. Berrey:
VanderMay & Doyle, lessee of a portion of the premise located
at 547 Court Street N.E., Salem, Oregon, hereby submits its
application for relocation benefits due to its displacement by the
Courthouse Square project. I understand from Mr. Hanna that you
have agreed to the submission of this application in two parts.
Since we have now received two estimates from movers referred to us
by the County and thus are able to quantify our claim with respect
to direct moving expenses, we are submitting that portion of the
benefit application now. Once we have determined the amount of any
other claims that we might have, such as reestablishment expenses
and expenses incidental to the move as outlined in 49 C.F.R. sec.
24.303, we will submit a second or supplemental application at that
time. We understand that under the governing federal regulations
we have up until eighteen months following the date of displacement
to submit any such application.
As I have explained to Mr. Hanna in a separate letter, at this
time I have not de.termined wh~ther ~he firm, which as of April 1,
1997, became The VanderMay Law Firm, and Mr. Doyle should be
treated as one or two displaced parties under federal law.
Pursuant to our discussion of this issue at our March 10, 1997,
meeting, I am submitting the attached claim for direct moving
expenses on behalf of VanderMay & Doyle. As you will see, this
claim includes direct moving costs for both the firm and Mr. Doyle.
Should we later conclude that the firm and Mr. Doyle should be
considered separate entities for the purpose of additional benefit
claims, I will submit a supplemental or additional application
solely on behalf of The VanderMay Law Firm.
At our March 10, 1997, meeting, we briefly discussed the
threshold question of whether VanderMay & Doyle meets the
eligibility requirements for relocation benefits. Since the
Department of Transportation claim forms do not include space for
