~ ~ ~ ~~r"~ <br />MEMORANDUM ~ <br />Community Development Department Urban Development Division <br />TO: Billy Wasson, Courthouse Square Project Manager D~^~ <br />~ r(l, ~ V <br />F R O M: J e ff D a t w y l e r, U r b a n D e s i g n C o o r d i n a t o r ~~ v L~ D <br />~ ~ D <br />DATE: April 16, ~ ss9 A P R ~ 9? 9 9 9 <br />MS RVICES DE q SUp~RT <br />SUBJECT: Change Order Request # 00002 Rl'MENT <br />Pursuant to your request for reimbursement for costs associated with reconstruction of public <br />utilities, the City has reviewed the subject change order. <br />C~:~r P!.~blic VV~rks Dppartment in ths cour~e of their r~eviewi of this change order rAGaest ;rit~ally <br />felt that there was sufficient cause to suspect that survey or design oversights on behalf of your <br />consultants may have been the reason for the utility conflict that gave rise to this change order. <br />They cited several possible reasons for the conflict encountered in the field: <br />1) The designer may not have performed a topo survey from paint marks on the pavement for <br />the sewer and gas lines and instead relied on as-built maps...or <br />2) The designer may not have accounted for the 72" diameter manhole. Had a normal manhole <br />been sufficient, there would not have been a conflict...or <br />3) During design, the gas line could have been mismarked on the pavement by NWNG causing <br />the topo survey to be incorrect. <br />It is also possible that: <br />4) The City of Salem could have mis- marked the sewer line during the design. <br />Given the these factors and the inability to make accurate measurements of the construction <br />documents because of the small scale of the drawings, there is insufficient information to assign <br />responsibility for the construction delays and costs associated with this utility conflict. <br />Far these reasQns, ard the rel~tively !ow ar~d reas~~a~le c~st of the r~qGest, the C~ty ~vi!! ~ct <br />dispute the change order. <br />Under the terms of the Intergovernmental Participation Agreement, Section 1.Improvements <br />~bject to Partici ap tion, Subsection E. Public Utilities , The Urban Renewal Agency of the City <br />of Salem hereby approves the change order request and increase to the participation amount <br />for Public Utilities. The Agreement participation amount approved for Public Utilities, $137,342 <br />shall be increased by $1,765 for a total of $139,107. <br />cc. Randy Curtis, General Services <br />
