AGREEMENT <br />Now therefore the parties agree as follows: <br />1. Improvements Subject to Participation. <br />Improvements to be undertaken in association with the Project by the County <br />and Transit District for which the Agency will provide funding under the terms and <br />conditions of this Agreement include: <br />~ A. Streetscape. <br />Streetscape improvements are the public improvements to be constructed <br />and located within the public right of way of the four block faces abutting the <br />Courthouse Square development site. Elements of the streetscape include an <br />architecturatly designed sidewalk including intersection corner bulbs, curbs, gutters, <br />landscape, street furniture, pedestrian lighting and street lighting. <br />B. Weather Protection. <br />Weather protection improvements are overhead canopy, marquee, or <br />arcade type structures attached to the Courthouse Square building facade extending <br />over the right of way or constructed to be free standing adjacent the right of w~y. The <br />designed purpose of weather protection improvements is to provide pedestrians an <br />overhead protection from the elements of the weather. <br />C. Traffic Signals. <br />Traffic signals requiring modification or construction to facilitate the <br />interfacing of bus and auto traffic at each of the four intersections adjacent the Project <br />shall include poles, mast arms, signal heads, controller devices, and required electrical <br />service. <br />D. On-Street Transit Facility. <br />The existing transit transfer facility located within the High Street right of <br />way shall be removed upon completion of the transit facility portion of the Project. <br />Elements included in the removal of the existing transfer facility include <br />demolition/salvage of improvements, street surface restoration, and reinstatement of <br />on-street parking. <br />E. Public Utilities <br />Utility improvements include the abandonment of existing public utilities <br />within vacated alley right of way and reconstruction of public utilities consisting of water, <br />storm sewer, and sanitary sewer within the public right of way surrounding the Project. <br />2.
