The development that occurs on the properiy is required to be, in par~ "transit- <br />supportive." There are no precise definitians, but we do I~ow that such uses as retai~ <br />housing, day care, and food sen+ices are generally considered to be transit-supportive_ <br />• Dependin.g o~ the timing of the private development, as well as pending current design <br />decisions by the County and Distnct, the pri~ate partner ma have an opportunity to <br />acquire as ma.ny as 66 parldng spaces in the undergtound structure. The additional <br />spaces will be aa add-alternate to the project bid package. <br />. Iand lease fees collected from the private partner w71 be divided between the Count~ <br />and District proportionally. Tt~e revenue can be used to reduce public costs by <br />offsetting operating costs of the Courthouse Sqaare facilities. ~ <br />• Tk~e private developer will have the option of having their ground-Ievel spaces ogen <br />onto the trazasit mall, as well as the Chemeketa St, frontage. <br />• The streetscape budget includes fundir~g for the Chemeketa St. frontage_ Depending <br />on the design and timing of the private dcvelopmerrt, we may seek a future amendment <br />to the budget package we are submitting to you today, to accommodate the timing and <br />final design of the private development._ <br />• The private developer will be a party to a land lease agreement, with the County and <br />Distriet, which will specify such conditions as building design features, allowed uses, <br />and other design considerations. ?his agreement will be subject to approvat by each <br />party, and by the Federal Transit Administration. <br />As a footnote on one other condition posed b~- the City, relative to obtaining a favorable <br />legal opinion about the Council's abality to exercise urban renewal levy authority: we <br />believe that tkr~e pa~ssage of Measure 50 has rendered this condition moot_ However, City <br />staff have ind.icated that they are pursuing this question with the City Attorney, and that <br />this issue will be resolved prior to any Counci] aaion on streetscape funding. <br />
