Transit District in Courthouse Square is <br />fi.~anced, in part, by a grant from the Federal Transit Administration under 49 USC Section 5307 <br />and 49 USC Section 5309; and <br />WHEREAS, in view of the participation of the Salem Area Mass Transit District in <br />Courthouse Square and in view of the role Marion County plays as the Local Contract Review <br />Boazd for itself and thz district, it is desirable to adopt a resolution authorizing both the district <br />and the county to employ the services of leasing agent as a personal service; and <br />WHEREAS, the Board of Conunissioners, after consideration of the provisions of <br />Ordinance No. 1051, the advice of Legal Counsel and the Contracts Officer, and all relevant <br />information submitted to the Board, finds that the services of e~cperienced and able commercial <br />leasing agents aze required for the Courthouse Square Project; that these services include <br />consultation, specialized knowledge and experience, and the exercise of sound professional <br />judgment and skills; and that these services aze not selected primarily on the basis of price; and <br />WHEREAS, the Boazd of CorrLmitsioners fmds that Marion County and its leasing agent <br />have unexpectedly severed their relationship; that Marion County requires the immediate services <br />of another leasing agent to obtain lease commitments to support favorable public fmancing terms <br />for the county's share of Courthouse Square construction costs; that the Transit District has <br />similar needs; that based on prevailing mazket fees for such services an exemption from <br />competitive selection requirements will not encourage favoritism or substantially diminish <br />competition; and that this exception will result in substantial cost savings to the county and <br />RESOLUTION NO. / 7 ~Z~~ <br />
