ORS 279.375(4) provides that the commissioner shall subject the contractor to a <br />civil penalty for failure to make timely payment of the prevailing wage rate fee. Please note that <br />each violation is separate and distinct and in the case of continuing violations, each day's <br />continuance is a separate and distinct violation. The minimum civil penalty which may be <br />assessed is an amount equal to the unpaid fee or $1,000, whichever is greater, for the first <br />violation of the prevailing wage rate fee requirement. <br />The Bureau requests that you respond to this notice by 14-Mar-98. Your response must include <br />payment of the prevailing wage rate fee or information which substantiates that the fee is not due <br />as indicated by the Bureau's records.
