I have <br />also reviewed all of the relocation information in this file. Following are my conclusions <br />regarding relocation benefits for this relocatee. <br />(1) Marion County did not follow the correct procedure for a negotiated move. According to <br />the Federal Relocation Act, the maximum payment for a negotiated move is based on moving <br />estimates and is agreed to by all parties "prior" to the move. Mr. Berrey submitted a negotiated <br />move agreement for $5,256.25 to Stephanie Black with Allann Bros. Coffee. There is no <br />evidence this moving amount was based on the lesser of two bids as required. Further, the <br />agreement was not signed by a representative of either the County or Allan Brothers Coffee. <br />On April 28, 1997, Mr. Berrey followed up with a fax letter request for reaching a negotiated <br />agreement for the move. There is no record that any agreement was reached. <br />(2) Allan Brothers Coffee moved themselves without first reaching an agreement with the County <br />for a negotiated self move. However, they did provide Mr. Berrey with the estimated amount <br />of $5,256.25 which was to include all labor costs for dismantling, moving and reassembling <br />personal property from the Beanery. Since the actual invoice submitted for labor, van rental and <br />storage is less than $5,256.25, the invoice for this part of the move should be allowed. <br />(3) I have reviewed the receipts and documentation attached to the invoice from Allann Brothers <br />Coffee Company. There appears to be sufficient documentation of actual, reasonable costs to <br />support the following conclusions: <br />Actual reasonable moving expenses: $7,682.23 <br />Actual reasonable reestablishment expenses (maximum allowed): 10,000.00 <br />Search for replacement site expenses (maximum allowed): 1,000.00 <br />Total: $18,682.23 <br />
