9828 <br />00123-3 <br />4. The Bid is based upon the materials, equipment and systems required by <br />the Bidding Documents without exception. <br />B. The Bidder shall not, at any time after the submission of Bid, set up any claims <br />whatsoever based upon insufficient data or incorrectly assumed conditions, nor <br />shall he daim any misunderstanding in regard to the nature, conditions or character <br />of woric to be done under the contrad and shall assume all risks resufting from any <br />changes in conditions which may occur during the progress of the work. Owner will <br />make no extra payments for oonditions which can be determined by examining the <br />site and documents. <br />1.3 PRE-BID CONFERENCE: <br />A. A pre-bid conference will be held at 1:30 p.m., Tuesday, January 12, 1999, at <br />Marion County Courthouse, Room 1330 (Board of Commissioners Hearing Room). <br />Attendance of bidde~s is not mandatory, but advised. <br />2 BIDDING DOCUMENTS <br />2.1 COPIES: <br />A. Bidders may obtain complete sets of the Biddi~ Documents from the issuing office <br />designated in the Advertisement or Invitation to Bid in the number and for the <br />deposit sum, if any, stated therein. The deposit will be refunded to Bidders who <br />submit a bona fide Bid (or are prime mechanical or electrical subcontractors) and <br />retum the Bidding Documents in good condition within ten (10) days after receipt <br />of Bids. The cost of replacement of missing or damaged documents will be <br />deducted from the deposit. A Bidder receiving a contrad award may retain the <br />Bidding Documents and the Bidder's deposit will be refunded. <br />2.2 INTERPRETATION OR CORRECTION OF BIDDING DOCUMENTS: <br />A. The Bidder shall carefutly study and compare the Bidding Documents with each <br />other, and with other wo~tc being bid concumerrtly or presently under constn~ction to <br />the extent that it relates to the work for which the Bid is submitted, shall examine <br />the site and local conditions, and shall at once report to the Architect errors, <br />inconsistencies or ambiguities discovered. <br />B. Bidders and sub-bidders requiring clarification or interpretation of the Bidding <br />Documents shall make a written request which shall reach the Archited at least <br />seven days prior to the date for receipt of bids. <br />C. Irrterpretations, corredions and changes of the Bidding Documents will be made by <br />Addendum. Interpretations, corredions and changes of the Bidding Documents <br />made in any other manner will not be binciir~g, and B'idders shall not rely upon them. <br />D. Questions received less than seven ('7) days before bid opening cannot be <br />answered. <br />2.3 SUBSTITUTIONS: <br />A. The materials, products and equipment described in the Bidding Documents <br />establish a standard of required function, dimension, appearance and quality to be <br />met by any proposed substitution. <br />
