The Owner will be Lnder no obliQation <br />~.i~y~L una~ hori~ed,gXjLa„3~1Ll~~SLSrjl3~i,~ W~~ <br />~grformed bv the ontractor witho~t a written Ch~nQe Order <br />~r o her written order to oroceed execLted bv the Owner. <br />7.3.8 If the Owner and Contractor do not agree with the <br />adjustment in Contract Time or the method for determining it, <br />the adjus~-ent or the method shall be referred to the <br />Aechitect for determination. <br />7.3.9 When the Owner and Contractor agree with the <br />determination made by the Architect conceming the <br />adjustments in the Contract Sum and Contract Time, or <br />otherwise reach agreement upon the adjustiments, such <br />agreement shall be effective immediately and shall be <br />recorded by preparation and execution of an appropriate <br />Change Order. <br />7.4 MINOR CHANGES IN THE WORK <br />7A.1 The Architect will have suthority to order minor <br />changes in the Work not involving adjustrnent in the Contract <br />Sum or extension of the Contract Time and not inconsistent <br />with the intent of the Contract Documents. Such changes <br />shall be effected by written order and shall be binding on the <br />Owner and Coatractor. The Contractor shall carry out such <br />written orders promptly. <br />ARTICLE 8 <br />TIME <br />8.1 DEFINITIONS <br />8.1.1 Unless otherwise provided, Contract Time is the <br />period of time, including authorized adjustments, allotted in <br />the Contract Documents for Substantial Completion of the <br />Work. <br />8.1.2 The date of commencement of the Work is the d,~ <br />established in the Agreement. The date shall not be <br />postponed by the failure to act of the Contractor or of persons <br />or entities for whom the Conti-actor is responsible. <br />8.1.3 The date of Substantial Completion is the date <br />certified by the Architect in accordance with Paragraph 9.8. <br />8.1.4 The term "day" as used in the Contract Documents <br />shall mean calendar day unless otherwise specifically defined. <br />8.2 PROGRESS AND COMPLETION <br />8.2.1 Time limiu stated in the Contract Documents are of <br />the essence of the Contract. By executing the Agreement the <br />Contractor confirms that the Contract Time is a reasonable <br />period for performing the Work. <br />8.2.2 The Contractor shall not knowingly, except by <br />agreement or instruction of the Owner in writing, prematurely <br />commence operations on the site or elsewhere prior to the <br />effective date of insurance required by Article 11 to be <br />furnished by the Contractor. The date of commencement of <br />the Work shall not be changed by the effective date of such <br />insurance. Unless the date of commencement is establishe <br />by a notice to proceed given by the Owner, the Contractdl~ <br />shall notify the Owner in writing not less than five days or <br />other agreed period before commencing the Work to permit <br />the timely filing of mortgages, mechanic's liens and other <br />securiry interests. <br />8.2.3 The Contractor shall proceed expeditiously with <br />adequaie forces and shall achieve Substantial Completion <br />within the Contract Time. <br />8.3 DELAYS AND EXTENSIONS OF TIME <br />8.3.1 If the Contractor is delayed at any time in progress <br />of the Work soletv by an act or neglect of the not in <br />conformance with the terms of the Contract Documents <br />9~ef~~es~, or ~~ other firm e€-a~t e~eyee~€ <br />, employed by the Owner, or <br />by changes ordered in the Work, as reflected in Chan~e <br />Orders anvroved~ the Owner that r.p ovide for the Contract <br />time to be extended, eF -~y~ ~al~e~ ~~conomic <br />industrv-wide strikes, fires, floods, earthquakes, or acts of <br />God, acu of war, or public enem inabili to obtain <br />materials due to ~ovemment restrictions, or ~~ cause <br />which Owner shall decide iustifies the delav then the <br />Owner-Contractor Agreement General Conditions Supplement (For AIA Doc.
