4.1.4 ~es -afis~g -~~ z~a~a~l~s -4~-?~ -a~- <br />~ " ~ <br />4.2 ARCHITECTS ADMINISTRATION OF THE <br />CONTRACT <br />4•2•1 The Architect will provide administration of the <br />Contract as described in the Contract Documents~}-}~ <br />~#e -9w~e~'s -fe~ese~e {-~} ~g ~~~.~ ~~- <br />~ ~F ~s -~ae -a~ {3~ -w~i~ -~#e ~s ~~s~ef~ <br />€~ ~e ~e -t~e -~~g ~e -set~est~e~ -~eFie~ ~esc~ie~ -i~ <br />~ -~~. The Construction Representative and <br />Architect eenerallv shall supervise and direct the Work The <br />Architect, with the anproval the Owner's _Representative in <br />each case and if so re4uested ~ the Owner, ~ Owner's <br />lender, if anv, shall sunervise and instruct the Contractor with <br />resnect to matters set forth in the Drawings and <br />Specifications. _ In addition to ~ s ecific _responsibilities <br />assiened elsewhere in the Contract Documenu, the Owner's <br />Renresentative shall decide anv and all Questions which mav <br />arise as to the rate of nroeress as to the Work <br />The Architect will advise and consult with the Owner. The <br />Architect will have authority to act on behalf of the Owner <br />only to the extent provided in the Contract Documenu, unless <br />otherwise modified by written instrument in accordance with <br />other provisions of the Contract. <br />~t.2.2 ~e -,4~s~tes~ ~} -~is~ -~e ~ite -aE ~^~~T <br />a{~eg~iate ~s-~e-st,age-e€-se~s~ie~-te ~ese~e-geeef~ <br />a~-i~sat~a.g-~~#e-~efl~; -~v~ie~-se~}eEe~; ~v~}-~e- <br />~-~~e~e-w~-x~e~-Bes~e~i~s:-The Architect <br />shall visit the site at intervals appropriate to the staee of <br />construction, or as otherwise a reed ~ the Owner and <br />Architect in writine to become sufficientlv familiar with the <br />ro ess and uali of the Work comnleted and the Work <br />being aerformed to determine that the Work is ~roceedine in <br />accordance with `the Contract Documents in all material <br />res°ects• <br />However, the Architect will not be required to make <br />exhaustive or continuous on-site inspections to check qualiry <br />or quantiry of the Work. On the basis of on-site observations <br />as an architect, the Architect will keep the Owner informed of <br />progress of the Work, and will e~ea~e~-exercise reasonable <br />care to guard the Owner against defects and deficiencies in <br />the Work. <br />4.2.3 The Architect will not have control over or charge of <br />and will not be responsible for construction means, methods, <br />techniques, sequences or procedures, or for safety precautions <br />and proarams in connection with the Work, since these are <br />solely the Contractor's responsibility as provided in Paragraph <br />3.3. The Architect will not be responsible for the Contractor's <br />failure to carry out the Work in accordance with the Contract <br />Documents. The Architect will not have control over or <br />charge of and will not be responsible for acu or omissions of <br />the Contractor, Subcontractors, or their agents or employees, <br />or of any other persons performing portions of the Work. <br />4.2.4 Communications Facilitating Contract <br />Administration. €~~se~ .as -eN~e~w+se -~e~e~ .~ ~. <br />6e~as~ -l~es~e~s -ef -+r~~ie~ -~fesE .~ave- <br />~ee~ -s~e~a~3` ~~e~; -~e -9-~v~ ~ ~astef -sl~~- <br />~~-~~~~~~e~~#e-Afs#+~es~. Except as <br />otherwise arovided in the Contract Documents or when direct <br />communications have been sueciallv authorized, the Owner <br />and Contractor shall communicate throush the Construction <br />Representative, and shall _contemooraneouslv rovide the <br />same communications to the Architect. Communications by <br />and with the Architect's consultants shall be through the <br />Architect. Communications by and with Subcontractors and <br />material suppliers shall be through the Contractor. <br />Communications by and with separate contractors shall be <br />through the Owner. <br />4.2.5 Based on the Architect's observations and <br />evaluations of the Contractor's Applications for Payment, the <br />Architect will review and certify the amounts due the <br />Contractor and will issue Certificates for Payment in such <br />amounts. <br />4.2.6 ~e -#st~~es~ -w~i~ ~e -at~er•i~} ..~e -~e~ec~ ~~- <br />+v~sl~ ~ees ~ -se~€e~ ~e ~e -6er~as~ ~~+3sa~e~s. The <br />Architect mav advise the Owner to reiect Work that dces not <br />conform to the Contract Documents. _ The Architect mav <br />advise the_Owner to reauire ins~ection or testinQ of the Work <br />in accordance with subnaraeranhs 13 5 2 and 13 5 3 whether <br />or not such Work is fabricated, installed or _completed. <br />Whenever the Architect considers it necessary or advisable <br />for implementation of the intent of the Contract Documents, <br />the Architect will have authority to require additional <br />inspection or testing of the Work in accordance with <br />Subparagraphs 13.5.2 and 13.5.3, whether or not such Work <br />is fabricated, installed or completed. However, neither this <br />authority of the Architect nor a decision made in good faith <br />either to exercise or not to exercise such authority shall give <br />rise to a duty or responsibility of the Architect to the <br />Contractor, Subcontractors, material and equipmeni suppliers, <br />their agents or employees, or other persons performing <br />portions of the Work. <br />4.2.7 The Architect will review and approve or take other <br />appropriate action upon the Contractor's submittals such as <br />Owner-Contractor Agreement General Conditions Supplement (For AIA Doc. A201) <br />~a9e - User pocument: A201 -- 12/29/1998. AIA License Number 100632, which expires on 12/7/1999 -- Page #16 <br />
