4.1.4 ~es -afis~g -~~ z~a~a~l~s -4~-?~ -a~- ~ " ~ 4.2 ARCHITECTS ADMINISTRATION OF THE CONTRACT 4•2•1 The Architect will provide administration of the Contract as described in the Contract Documents~}-}~ ~#e -9w~e~'s -fe~ese~e {-~} ~g ~~~.~ ~~- ~ ~F ~s -~ae -a~ {3~ -w~i~ -~#e ~s ~~s~ef~ €~ ~e ~e -t~e -~~g ~e -set~est~e~ -~eFie~ ~esc~ie~ -i~ ~ -~~. The Construction Representative and Architect eenerallv shall supervise and direct the Work The Architect, with the anproval the Owner's _Representative in each case and if so re4uested ~ the Owner, ~ Owner's lender, if anv, shall sunervise and instruct the Contractor with resnect to matters set forth in the Drawings and Specifications. _ In addition to ~ s ecific _responsibilities assiened elsewhere in the Contract Documenu, the Owner's Renresentative shall decide anv and all Questions which mav arise as to the rate of nroeress as to the Work The Architect will advise and consult with the Owner. On the basis of on-site observations as an architect, the Architect will keep the Owner informed of progress of the Work, and will e~ea~e~-exercise reasonable care to guard the Owner against defects and deficiencies in the Work. 4.2.3 The Architect will not have control over or charge of and will not be responsible for construction means, methods, techniques, sequences or procedures, or for safety precautions and proarams in connection with the Work, since these are solely the Contractor's responsibility as provided in Paragraph 3.3. The Architect will not be responsible for the Contractor's failure to carry out the Work in accordance with the Contract Documents. Except as otherwise arovided in the Contract Documents or when direct communications have been sueciallv authorized, the Owner and Contractor shall communicate throush the Construction Representative, and shall _contemooraneouslv rovide the same communications to the Architect. Communications by and with the Architect's consultants shall be through the Architect. Communications by and with Subcontractors and material suppliers shall be through the Contractor. Communications by and with separate contractors shall be through the Owner. 4.2.5 Based on the Architect's observations and evaluations of the Contractor's Applications for Payment, the Architect will review and certify the amounts due the Contractor and will issue Certificates for Payment in such amounts. 4.2.6 ~e -#st~~es~ -w~i~ ~e -at~er•i~} ..~e -~e~ec~ ~~- +v~sl~ ~ees ~ -se~€e~ ~e ~e -6er~as~ ~~+3sa~e~s. The Architect mav advise the Owner to reiect Work that dces not conform to the Contract Documents. _ The Architect mav advise the_Owner to reauire ins~ection or testinQ of the Work in accordance with subnaraeranhs 13 5 2 and 13 5 3 whether or not such Work is fabricated, installed or _completed. Whenever the Architect considers it necessary or advisable for implementation of the intent of the Contract Documents, the Architect will have authority to require additional inspection or testing of the Work in accordance with Subparagraphs 13.5.2 and 13.5.3, whether or not such Work is fabricated, installed or completed. However, neither this authority of the Architect nor a decision made in good faith either to exercise or not to exercise such authority shall give rise to a duty or responsibility of the Architect to the Contractor, Subcontractors, material and equipmeni suppliers, their agents or employees, or other persons performing portions of the Work. 4.2.7 The Architect will review and approve or take other appropriate action upon the Contractor's submittals such as Owner-Contractor Agreement General Conditions Supplement (For AIA Doc.
