5. NUISANCES. No nuisances will be allowed upon the Condominium property, nor any use or <br />practice that is the source of annoyance to occupants or which interferes with the peaceful possession and <br />proper use of the property by its occupants. All parts-of the Condominium will be kept in a clean and <br />sanitary condition, and no rubbish, refuse or garbage allowed to accumulate, nor any fire hazard allowed to <br />exist. All such garbage and trash shall be placed inside disposal containers. No unit owner will permit any <br />use of its office unit or make any use of the common elements that will increase the cost of insurance upon <br />the Condominium property. <br />6. IMPROPER. OFFENSIVE OR UNLAWFIIL USE. No improper, offensive or unlawful use will <br />be made of the Condominium property nor any part of it; all valid laws, zoning ordinances and regulations <br />of governmental bodies having jurisdiction will be observed. The responsibility of ineeting the <br />requirements of governmental bodies for maintenance, modification or repair of the Condominium <br />property will be carried out and paid for in the same manner as the responsibility for the maintenance and <br />repair of the property concerned. <br />. 7. RESTRICTION ON EXTERIOR INSTALLATIONS . No unit owner, resident or lessee shall <br />install external wiring for electrical or telephone installation, exterior antennae, machines or air <br />conditioning units or similar devices on the exterior of the Condominium building or cause them to <br />protrude through the walls or the roof of the Condominium except as authorized by the Board of Directors. <br />No window guazds,~wnings or shades shall be installed without the prior consent of the Board of Directors. <br />8. ADDI'TIONAL RULES. Rules and regulations concerning other use of the Condominium <br />property may be made and amended from time-to-time by the Association or the Board of Directors. <br />Copies of such rules and regulations will be furnished to all unit owners and residents of the Condominium, <br />upon request. <br />9. GOVERNMENTAL USE. All units must be owned by a governmental entity. Units and <br />common elements shall be occupied only by governmental entities and such private tenants who are tenants <br />under a lease from a unit owner. <br />10. COVENANTS. CONDITIONS. RESTRICTIONS AND EASEMENTS IN OTHER <br />DOCUMENTS. Each owner of a unit in the Condominium is subject to covenants, conditions, restrictions <br />and easements of record. <br />11. TRANSIT CONTINUING CONTROL. Anything in the Declaration or Bylaws to the contrary <br />notwithstanding, no Unit owner (in its capacity as a Unit owner and exclusive of the exercise by a Unit <br />owner of its police power in a manner generally applicable to the public), shall have the right to burden or <br />interfere with the operation of the transit system by the Salem Area Mass Transit District in a manner <br />reasonably consistent with usual and customary practices of transit system operations, .or to burden, "" <br />interfere with or revent access to, or ingress to and egress from, an Unit held by the Sa~em Area Mass <br />Transit District. The Unit owners acknowledge that the ownership interests of the Salem Area Mass Transit <br />Distnct have been acquired in part with federal funds provided to the Transit District by the Federal Transit <br />Administration pursuant to a grant agreement under 49 USC §5301 et seq. The federal government retains <br />a continuing interest in all structures, equipment and other facilities acquired or constructed with federal <br />funds that may be located in or upon the property. If, for any reason, such structures, equipment or <br />facilities are not used for transit purposes defined by the applicable law, regulations, grant agreements and <br />FTA Master Agreement, for a penod of at least 30 years from the date of the Declaration the Federal <br />Transit Administration shall be entitled to reimbursement as provided under 49 CFR part 18 for its <br />proportional shaze of the fair market value of such property funded by the Federal Transit Administration. <br />Notwithstandmg any provision o the Dec aration or the Bylaws to the contrary, this Section may not be <br />amended without the approval of the Salem Area Mass Transit District and the Federa( Transit <br />Administration, or the successors to their governmental authority. <br />Bylaws Courthouse Squaze Condominium <br />Page - 10 <br />1211980126 <br />
