parking garage common area shall include the ramps and sidewalks from the curb to the <br />parking level as depicted on the plat, but shall not include the Parking Units, the storage <br />areas, elevator shafts, walk aisles, stairways and lobby areas located under the building <br />footprint, as depicted on the plat. The parking garage common azea shall be owned by <br />the Unit Owners in the same proportion as the number of parking spaces owned by each <br />owner within their respective Parking Units bears to the total number of parking spaces <br />in the parking garage; and ~ <br />_' (h) All other elements of the building necessary or convenient to <br />its existence, maintenance and safety, or which are nocmally in common use. <br />4.2 Maintenance Repair and Replacement• Liabilitv for Common Expense. <br />(a) General. The cost of maintenance, repair and replacement of the <br />common elements shall be a common expense, and the perfonnance of such work shall <br />be ihe responsibility of the Association. achUnit owner will be liable for the common <br />expense as provided in this Section. Nothing herein contained, however, shall be <br />construed so as to preclude the Association from delegatimg to persons, firms or <br />corporations of its choice, such duties as may be imposed by the Association. <br />.(b) Office Units. The cost of maintenance, repair and replacement of all <br />the common elements, except as expressly set forth otherwise in this Secdon, shall be the <br />liability of the owners of the Office Units. Office Unit 1 shall bear 20.07~Yo of such costs <br />and O~ce Unit 2 shall bear 79.93% os such costs. Each owner of an Office Unit shall <br />bear the entire cost of maintenance, repair and replacement of such Office Unit or any <br />portion thereof. ~ <br />(c) Hearing Room Unit. The cost of maintenance, repair and <br />replacement of the Hearing Room Unit shall be shazed equally by the owners of the <br />Hearing Room Unit and the performance of such work shall be the responsibility of the <br />Association. The Hearing Room shall be used in accordance with Section 6.2. <br />(d) all nit. The owner of the Mall Unit shall be responsible for the <br />performance and cost of maintenance, repair and replacement of the Mall Unit or any <br />portion thereof. <br />~ (e) Parking Garage. The cost of maintenance and repair of the parking <br />garage common uea (described in Section 4.1(g)) necessitated by normal wear and tear <br />shall be bom by the owners of the Pazking Units in same proportion as the number of <br />parking spaces owned by each owner within their respeciive Parking Units bears to the <br />total number of parking spaces in the parking garage. The cost of maintenance and <br />repair of the upper (ceiling) concrete slab of the parking garage common area <br />necessitated by normal wear and tear attributable to the use of the Mall Unit shall be <br />born by the owner of the Mall Unit. The cost of structural repairs and replacement of <br />that portion of the upper (ceiling) concrete slab of the parking garage common area <br />located immediately below the Mall Unit shall be bom SOR6 by the owner of the Mall <br />Unit and 50% by the owner of the CP Unit <br />Nothing herein contained, however, shall be construed so as to preclude the Association <br />from delegating to persons, firms or corporations of its choice such duties as may be <br />imposed by the Association. <br />4.3 Income From Common Elements. All common revenue from the general common <br />elements (except the parking guage common azea) .shall be income of the Association.
