plan or program is financially responsible, and that the plan or program has been communicated in
<br />writing to the laborers or mechamcs affected, and records which show the costs anticipated or the
<br />actual cost incurred in providing such benefits. Contractors employing apprentices or tramees under
<br />approved programs shall maintain written evidence of the registration of apprenticeship programs
<br />and certification of trainee programs, the registration of the apprentices and tramees, and the ratios
<br />and wage rates prescribed in the applicable programs.
<br />Section 107 (OSHA):
<br />Contract Work Hours and Safety Standards Act - The Contractor agrees to comply with section
<br />107 of the Contract Work Hours and Safety Standards Act, 40 U.S.C. section 333, and applicable
<br />DOL regulations, "Safety and Health Regulations for Construction" 29 C.F.R. Part 1926. Among
<br />other things, the Contractor agrees that it will not require any laborer or mechanic to work in
<br />unsanitary, hazardous, or dangerous sunoundings or working conditions.
<br />Clean Air - The Contractor agrees to comply with all applicable standards, orders or regulations
<br />issued pursuant to the Clean Air Act, as amended, 42 U.S.C. §§ 7401 ~ e~ . The Contractor agrees
<br />to report each violation to the Recipient and understands and agrees that the Recipient will, in turn,
<br />report each violation as required to assure notification to FTA and the appropriate EPA Regional
<br />Office.
<br />Clean Water - The Contractor agrees to comply with all applicable standards, orders or regulations
<br />issued pursuant to the Federal Water Pollution Control Act, as amended, 33 U.S.C. 1251 et se~c . The
<br />Contractor agrees to report each violation to the Recipient and understands and agrees that the
<br />Recipient will, in turn, report each violation as required to assure notification to FTA and the
<br />appropriate EPA Regional Office.
<br />Certi~cation Regardi Debarment, Su~pension, and Other Resnonsibilitv Matters
<br />1. By signing and submitting this Contract, the Contractor is providing the signed certi~cation set
<br />out below .
<br />2. The certification in this clause is a material representation of fact upon which reliance was placed
<br />when this transaction was entered into. If it is later determined that the Contractor knowingly
<br />rendered an erroneous certification, in addition to other remedies available to the Federal
<br />Government, Recipient may pursue available remedies, including suspension and/or debarment.
<br />3. The Contractor shall provide immediate written notice to Recipient if at any time the Contractor
<br />learns that its certification was erroneous when submitted or has become erroneous by reason of
<br />changed circumstances.
<br />4. The terms "covered transaction," "debarred," "suspended," "ineligible," "lower tier covered

<br />transaction, participant, persons, lower tier covered transaction," "principal," "proposal," an
<br />"voluntarily excluded," as used in this clause, have the meanings set out in the Definitions and
<br />Coverage sections of rules implementing Executive Order 12549 (49 CFR Part 29]. You may contact
<br />Recipient for assistance in obtaimng a copy of those regulations.
<br />5. The Contractor agrees by submitting this proposal or entering into this Contract that, should the
<br />proposed covered transaction be entered into, it shall not knowingly enter into any lower tier covered
<br />transaction with a person who is debaned, suspended, declared ineligible, or voluntarily excluded
<br />from participation in this covered transaction, unless authorized in writing by Recipient.
<br />6. The Contractor further agrees by submitting this proposal or entering into this Contract that it will
<br />include the clauses 10 and 11, below, without modification, in all lower tier covered transactions and
<br />in all solicitations for lower tier covered transactions.
