NOTIFICATIONS AND PERMITS: The CONTRACTOR shall be responsible for filing and bearing the cost of all Notifications and Pemuts for all poRions of the demolition work. 8 0 2. ENVIRONMENTAL PROTECI'ION: Under the provisions of ORS 279.318, if this contract is for a public improvement as defined by ORS 279.011(6), the CONTRACTOR must comply with all Federal, State, and local statutes, ordinances and regulations dealing with the prevention of environmental pollution and preservation of natural resources that affect the projec~ These include the requirements of Environmental Protection Agency (Region 10), U.S. Army Corps of Engineers, and the Oregon Departxnent of Environmental Quality. If CONTRACTOR is delayed or must undertake additional work by reason of existing regulations or ordinances of agencies dealing with the prevention of envimnmental pollution and the preservation of natural resources that affect the performance of this contract and that have not been cited in this contract, or are due to the enactment of new or the amendment of existing statutes, ordinances or regulations relating to the prevention of environmental pollution and the preservation of natural resources occurring after the subtnission of the successful bid OWNER shall grant a time extension and issue a change order setting forth the additional work that must be undertaken. The change order shall not invalidate the contract and there shall be a reasonable extension of the contract time. 8 0 3 . PATENT : As a condition to entering into the contract agreement, the Contractor assumes full responsibility for any applicable licensing agreement that may be required to accomplish the work set forth within the technical specifications when any device or process specified herein or required by the work is subject to the United States Patent or Trademark. The process and devices specified within the technical specifications are not intended to grant any rights to the Contractor. The Contractor agrees upon entering the contract to obtain any reqiured licensing agreements enforceable under the Umted States Patents or Trademark, and further the Contractor, and his surety, agree to hold the Owner and Technical Consultant harmless for damages for Patent or Trademark infringement including cost for attomeys fees of said Owner or Technical Consultant. 8 0 4. CONTRACTOR REGISTRATION AND LICENSING: The Contractor shall provide written evidence to the Owner proving that contractor is a registered or licensed as required by law of Oregon State. 8 0 5. LIOUIDATED DAMA~FS: In the event that the Contractor should fail to complete the work under this contract by the specified time of completion, or any extensions thereof, the Contractor shall pay to the Owner as fixed, agreed and liquidated damages the sum of $600.00 for each calendar day of delay. This shall apply individually to each project.
