BUREAU OF LABOR AND INDUSTRIES - WAGE AND HOUR DIVISION <br />INSTRUCTIONS FOR COMPLETING PAYROLL/CERTIFIED STATEMENT FORM, <br />WH-38 (Rev 6/96) <br />General: This form meets needs resulting from the 1983 amendments to the prevailing wage rate law. Under <br />this amended law, the contractor is required to pay not less than fringe benefits as predetermined by the <br />Bureau of Labor and Industries, in addition to payment of not less than the predetermined rates. The <br />contractor's obligation to pay fringe benefits may be met either by payment of the benefits to the various <br />plans, funds, or programs or by making these payments to the employees as cash in lieu of fringe benefits. <br />This form provides for the contractor's showing of the payroll and all monies paid to the employees, whether <br />as basic rates or as cash in lieu of fringe benefits, and provides for the contractor's representation in the <br />payroll/certified statement that he/she is paying other benefits required by the contract and not paid as cash in <br />lieu of fringe benefits. Detailed instructions concerning the preparation of the form follow: <br />Complete the box at the top of the form. Complete the appropriate prime contractor or subcontractor box. Be <br />sure to enter the date the contract was first advertised for bid. If you are not sure of this date, contact the <br />Public Contracting Agency. <br />['ol~mn 1- Name Address and Social Security number of Emqlovee: The employee's full name must be <br />shown on each payroll submitted. The employee's address must also be shown on the first payroll submitted. <br />The address need not be shown on subsequent payrolls unless the address changes. Although not required, <br />space is available in the name and address section so that Social Security numbers can be listed. <br />c'ol~+mn 2- Trade Classifications: List the classification found in the Bureau of Labor and Industries' <br />publication "Prevailing Wage Rates for Public Works Contracts in Oregon," which is most descriptive of the <br />work actually performed by the employee. Give the group number for those worker classifications which <br />include such information. Consult the worker classifications and minimum prevailing wage rate schedule set <br />forth in contract specifications. Refer to the appropriate prevailing wage rates in effect at the time the <br />contract was first advertised for bid for information regarding trade classifications, basic hourly rates, and <br />hourly fringe benefits. Indicate which workers are apprentices, if any, and give their current percentage, trade <br />classification, and group number when applicable. If additional worker classifications are deemed necessary, <br />contact the contracting public agency. If an employee works in more than one worker classification, use the <br />highest rate for all hours worked, or use separate line entries to show hours worked, rate of pay, and fringe <br />benefit for each classification. <br />~ol~mn 3- DAY AND DATE: Enter the day of the week (M, T, W, Th, F, S, Sn) in the top row of boxes, and <br />the number of the day of the month below. <br />- HOllRS WORKED EACH DAY: Enter as overtime hours all hours worked in excess of 8 hours per day, all <br />hours worked on Saturday and Sunday and all hours worked on tegal holidays as defined in ORS 279.334. See <br />ORS 279.334(3) for exceptions to this requirement. <br />c'olumn 4- Total Hours: Enter separately the total number of overtime hours and straight time hours worked <br />by each listed classification during this pay period; overtime ("OT") on top, straight time ("S") immediately <br />below. <br />rol~mn 5- Basic Hourly Rate of Pav: Enter the basic hourly rate and the overtime hourly rate (if any) paid the <br />employee in the appropriate overtime and straight time boxes. Payment of not less than one and one half <br />times the basic or regular rate paid is required for overtime under ORS 279.334. <br />rol~mn 6- Hourlv Fringp R~-^-~f~± ?A~~! as Wagec to the Em I~ovee: Enter any additional cash paid directly to the <br />employee in lieu of fringe benefits. It is not necessary to pay time and a half for overtime work on those <br />wages which are paid in ~ieu of fringe benefits. <br />~ol~mn 7- Gross amount ~~roe~ Enter the gross wages earned by the worker in this classification for all <br />listed straight time hours, all listed overtime hours, and including all additional amounts paid directly to the <br />employee. <br />
