We receiued a signed contract frorn Marian County on Wednesday, May
21 , 1997. On May 22, 1 997 you faxed Staton a letter indicating you are
concemed that Staton appears to hs~ve lagged behind on contract ok~ligations.
The signed contract clearly gives Staton 7-10 days to submit an the items
you have question~d. Th~ cantract was executed on May 2D. 1997, which
gives Statan until May 2? or May 30, 1997. Please clarify how St~ton is out
af compli~rtGe on submittals. As I now understand it from your letter, you
desire to m~dify most af the submittal time requirements in an effort to
s~eed the project up. ~Ne wilf confirm and clarify this in our 1;30 meeting ~f
today.
2.) 7wo weeks ago, when Mike Staton hand delivered aur contract to you,
you persanally indicated to Mike ihat yau desired to wai~e the time
requirements on submittals, with the exception af th~ permits, bond and
ins~rance, in an effort to expedite project start up. Does this statemEnt
reflect your recallection of this conversatian?
3.} In a spirit of coaperation, ~nd since May 15, 1997, Statvn has been
faithfully working on this project. Much has been accomplished, and until
Wednesday of last week, a~l with~ut a signed contract.
4.) Your level c~f anxiety is ~pparent and understandak~le regarding this
contract, which v~ras aver twa months behind schedule when we received
our contraCt. No delays ta date are the resuit of Staton actians, and so it is
difficult ta understand how you have pla~ced so much cancern on our level of
effort.
[3kQ ~It:kNS~ ti t2407 & 124~8 OR CCB ~p3371 EPAfD~Q iPp flR1~9tH7~7237
