Enclosed you will find a recent addendum to the interim agreement, <br />which, together with the previously-executed interim agreement, the AIA contract for <br />services, supplemental provisions to the AIA contract, and Federal conditions, comprises <br />the architecturaUengineering services package. <br />Ben Fetherston's letter of Apri122, 1998, to Shelly Brown, contained an earlier draft of <br />the addendum, as well as the other contract documents. The only changes that have been <br />made since that mailing are in the addendum. You were copied with the Apri1221etter <br />and enclosures, so I'm now sending on to you the final version of the addendum (replacing <br />the previous version) to add to the rest of the contract documents. For the sake of clarity, <br />we understand the contract documents to include the interim agreement, the addendum to <br />the interim agreement, the AIA contract, the supplemental provisions to the AIA contract, <br />and the FTA contract requirements addendum. While this "package" approach to the A&E <br />contract is perhaps a bit unwieldy, we thought it was the best way to retain the history of <br />the contracting process that has taken place with the architectural consultant. <br />As you'll note in the addendum, the architect has given us credit for a portion of the work <br />that was completed on the "old design." The amount shown in the addendum, $180,421 -- <br />a portion of the $434,881 that was expended by the County and the District on the old <br />design -- is considered to represent work wtuch is applicable to the redesign of the project, <br />and thus is credited within the 6% fee that the architect is eaming on the project. We <br />assume that this sum will be eligible for FTA funding, as it is original work which pertains <br />directly to the design and engineering of the current project. <br />The $180,421 credit for previous work is a substantially larger sum than had been initially <br />proposed by the architect.
