Emew Trust ("GRANTOR") is the owner of the following <br />two lots (or parcels) of real property located in Marion County, Oregon, to wit: <br /> <br />LOt 1: ~ra~ ~ <br /> Legal Description of Dale and Be~y~Homestead: Includes 60413000 and 60411000 <br /> <br />Beginning at a point which is 1654.70 feet North 25° 30' West from the quarter comer <br />between Sections 4 and 9 in Township 9 South, Range I West of the Willamene <br />Meridian, Marion Couhty, Oregon; and running thence North 25° 30' West 143.13 feet <br />thence East 1603.13 feet thence South 00° 26' East 259.93 feet thence West 600.00 feet <br />thence North 00° 26' West 130.00 feet thence West 402.09 feet to the point of beginning. <br /> <br />Lot II: <br /> <br />Beginning at a poim which is 1797.91 feet Noah 25° 30' West from the quarter comer <br />between Sections 4 and 9 in Township 9 South, Range I West of the Willamene <br />Meridian, Marion County, Oregon; and running thence North 25° 30' West 197.43 feet to <br />a point; thence East t I46.76 feet to an iron rod in the East line of that certain tract of land <br />conveyed to Marc E. Landon and Ruth Landon by deed recorded in Volume 381, Page <br />192, Deed Records for Marion County; thence South 00° 26' East, along said East line, <br />178.20 feet to an iron rod; thence West 1063.13 feet to the point of beginning. <br /> <br />SAVE & EXCEPT Tax Lot 60415000. <br /> <br /> WHEREAS GRANTOR has applied to the State of Oregon through its Department of <br />Envirgnmental Quality ("State" or "GRANTEE") for a report of site evaluation for the proposed <br />construction of an individual on-site sewage disposal system ("Report") on Lot II intended to <br />serve Lot 1; and <br /> <br /> WHEREAS Oregon Administrative Rules, 340-71-130(11 )(b) and 340~71 - 150(4)(a) <br />require GRANTOR to execute an easement and covenant in favor of the State as a condition <br />precedent to issuance of a favorable report concerning the construction of a system on one lot <br />intended to serve another lot; <br /> <br /> NOW THEREFORE, in consideration of the issuance of the report to GRANTOR by the <br />State, and other good and valuable consideration, receipt of which is hereby acknowledged, <br />GRANTOR hereby conveys to the State ("GRANTEE"), its successors and assigns, a perpetual, <br />non-ex, elusive, appurtenant easement in, upon, and running with Lot II allowing the GRANT- <br />EE'S meficers, agents, employees and representatives to enter and inspect, including by excava- <br />tion, the on-site sewage disposal system on Lot II serving Lot I. <br /> <br /> <br />
