Any interested <br />person who disagrees with the Director's decision may request that <br />the application be considered by the Marion County Hearings Officer <br />after a public hearing. The applicant may also request a recon- <br />sideration (one time only & a $150 fee) on the basis of new <br />information subject to signing an extension of the 120 day time <br />limit for review of zoning applications. <br /> <br />A public hearing is held on appeals subject to the appellant paying <br />a $150.00 fee. Requests for reconsideration, or consideration by <br />the Hearings Officer, must be in writing (Appeal Form available <br />from the Planning Division) and be received in the Marion County <br />Planning Division, 3150 Lancaster Drive NE, Suite ~B", Salem by <br />4:30 p.m. on NOVEMBER 13, 1997. This <br />decision is effective NOVEMBER 14, 1997 unless further <br />consideration is requested. <br /> <br />FINDINGS AND CONCLUSIONS: The findings and conclusions on which <br />the Director based his decision are noted below. <br /> <br />The subject property is designated Rural Residential in the <br />Marion County Comprehensive Plan. The purpose of this <br />designation and the corresponding AR (ACREAGE RESIDENTIAL) <br />zone is to allow for acreage homesites. Although only one <br />residence is permitted on each parcel, a temporary mobile home <br />under hardship conditions may be approved as a conditional use <br />provided the need is justified. <br /> <br />2 o <br /> <br />The property is located on the north side of James Way, <br />approximately 1200 feet east of the intersection of Sherman <br />Road and James Way SE. <br /> <br />Ail surrounding properties are in rural residential develop- <br />ment and zoned AR. <br /> <br />4 o <br /> <br />A signed Physician's Certificate has been submitted for <br />Patricia Hannum indicating she has medical conditions that <br />preclude her from maintaining a complete separate and detached <br />dwelling apart from her family. <br /> <br /> <br />
