NOTICE TO MORTGAGEE, LIENHOLDER, VENDOR, OR SELLER: ORS CHAPTER <br />215 REQUIRES THAT IF YOU RECEIVE THIS NOTICE, IT MUST PROMPTLY BE <br />FORWARDED TO THE PURCHASER. <br /> <br />NOTICE OF DECISION <br />FLOODPLAIN/GREENWAY DEVELOPMENT PERMIT <br /> CASE NO. 96-27 <br /> <br />APPLICATION: Application of Robert and Susan Alton for a permit to <br />construct a retaining wall within the identified 100 year flood- <br />plain and greenway of the Willamette River on a .24 acre parcel in <br />an AR (ACREAGE RESIDENTIAL) zone for property located at 24075 <br />Butteville Road NE, Aurora. (Section 32BD; T3S; R1W). Tax account <br />40045-000. <br /> <br />DECISIONs Notice is hereby given that the Planning Director for <br />Marion County has APPROVED the above described Floodplain/Greenway <br />Development application so3oject to certain conditions. <br /> <br />This Floodplain/Greenway Development Permit is valid only when <br />exercised by NOVEMBER 13, 1997. The effective period of an <br />approved application may be extended for an additional year subject <br />to approval of an extension (Extension form available from the <br />Planning Division). <br /> <br />This decision does not include approval of a building permit. <br /> <br />CONDITIONS: The following conditions must be met before a buildinq <br />permit can be obtained or the approved use established: <br /> <br />The applicants shall obtain any building permits required by <br />the marion county Building Inspection Division. <br /> <br />A registered engineer or architect shall certify that the <br />retaining wall meets the requirements identified in Section <br />178.060(c) (2) . <br /> <br />A registered engineer or architect shall certify that the <br />retaining wall is anchored in a manner to prevent floatation, <br />collapse or lateral movement of the structure. <br /> <br />The applicants shall provide certifications from a registered <br />engineer or architect as required in Sections 178.060(e) (1) <br />and (e)(2). <br /> <br />The applicants shall submit certification from a registered <br />professional engineer or architect demonstrating that the <br />encroachments shall not result in any increase in flood levels <br />during the occurrence of the base flood discharge.
