MARION COUNTY BUILDING INSPECTION <br />LAND USE COMPATIBILITY STATEMENT (LUCS) <br />for ON-SITE SEWAGE SYSTEMS <br /> <br />ORS 197.180 and DEQ's coordination and permit consistency programs, as approved by LCDC, require that pem~its <br />for new or expanded on-site sewage disposal systems not be issued until a favorable statement of land use <br />compatib~ity is provided from the responsible local planning authorities. The Land Use Compatibility Statement <br />must certify that the proposal is compatible with applicable LCD - acknowledged local comprehensive land use plans <br />and implemenfing measures or statewide planning goals. A completed compatibility statement must be provided with <br />each permit application for a new or expanded on-site sewage disposal system. <br /> <br />A permit cennot be issued if a negative Compatibility Statement is received. The local jurisdiction will need to provide <br />a favorable land use statement before DEQ can proceed with a permit application. A favorable Compatibility Statement <br />may also be required before an Authorization Notice can be issued. <br /> <br />WHAT IS A LUCS? The LUCS is the process Marion County uses to determine that Marion County permits and other <br />approvals that affect land use are consistent with the local comprehensive plan. <br /> <br />~q-lY IS LUCS REQUIRED? Oregon Law requires that state agency land use-related activities be consistent with local <br />cempmhensive pians., The DEQ DMsion 18 Administrative Rules identify agency ac'dons that are defined as programs <br />affecting land uss. These programs must have a process for determining local plan consistency. The LUCS cannot <br />be approved until all requirements are met. <br /> <br />WHEN IS A LUCS REQUIRED? A LUCS is required for nearly all Marion County On-Site Sewage Disposal construction <br />-installation permits. <br /> <br />HOW TO COMPLETE A LUCS: <br /> <br />Applicant completes section I <br /> <br />Submit to the local planning office to determine if the business or facility meets all local planning requirements. <br /> <br />The local planning office must attach written findings of fact for local reviews or other necessary approvals <br />before establishing LUCS consistency. <br /> <br />The applicant submits the completed LUCS and attachments to Madon County Building Inspection with the <br />application for on-site sewage .~system permit. <br /> <br />SECTION '~ .
