FINDINGS AND CONCLUSIONS: The findings and conclusions on which <br />the Director based has decision are noted below. <br /> <br />The subject property is designated Primary Agriculture in the <br />Marion County Comprehensive Plan and is zoned EFU (EXCLUSIVE <br />FARM USE). The primary intent of the Comprehensive Plan and <br />zone designation is to promote the continuation of commercial <br />agricultural operations. <br /> <br />The subject property is located on the east side of Butteville <br />Road at the northeast corner of its intersection with the <br />Wiseacre Lane NE. The Southern Pacific Railroad right-of-way <br />forms the subject property's eastern boundary. The property <br />currently contains an existing mobile home and single family <br />dwelling. <br /> <br />Properties surrounding the subject parcel on all sides are <br />zoned EFU. Land surrounding the parcel is primarily used for <br />small to medium scale farm operations and a few non-farm <br />homesites. <br /> <br />A lawfully established dwelling may be altered, restored or <br />replaced if the dwelling: <br /> <br />(1) Has intact exterior walls and roof structure; <br /> <br />(2) <br /> <br />Has indoor plumbing consisting of a kitchen sink, toilet <br />and bathing facilities connected to a sanitary waste <br />disposal system; <br /> <br />(3) Has interior wiring for interior lights; <br /> <br />(4) Has a heating system; and <br /> <br />(5) <br /> <br />In the case of replacement, is removed, demolished or <br />converted to an allowable nonresidential use within three <br />months of the occupancy of the replacement dwelling. <br /> <br />The applicants are proposing to replace the existing dwellings <br />on the subject property. The existing dwellings consist of a <br />mobile home and a frame constructed dwelling. The mobile home <br />is not classified under the Assessor's rating code and the <br />frame dwelling is rated as 40% good. Assessor's records <br />indicate that the frame dwelling was placed on the property in <br />1940 and a review of aerial photographs indicate the mobile <br />home was on the subject parcel before January 1, 1977. <br />Therefore, both dwellings were placed in accordance with the <br />land use laws in affect at that time. A site visit by the <br />Planning Division staff indicates that the existing mobile <br />home and dwelling comply with the criteria listed in 4 (1) <br />through (4) above. The criteria listed in 4 (5) above will be <br />met through the conditions of approval <br /> <br /> <br />
