from A to Z Wine Works stated that payments made to GBF LLC were: $174,490.50 in 2023; $271,615.45 in <br />2024; and $191,399.70 in 2025. The per year amount paid through this contract totals at least $80,000 and was <br />due to sales of a farm product grown on the subject tract. Therefore, the criterion is met. <br /> <br />c. The subject tract is currently employed for the farm use that produced the income <br />required in subsection (A)(1)(b) of this section; <br /> <br />In the aerial imagery from May 2025 found in the Marion County Land Use Planning GIS viewer tool the subject <br />tract still visibly contains grape vines. The applicant also provided imagery from Google Streetview from May <br />2025 that showed a view of the vineyard from the road in which the grape vines were clearly visible. Further, the <br />applicant provided updated aerial imagery from April 2026, which shows the grapevines still in place on the tract. <br />Therefore, the subject tract is still employed for the farm use that produced the income. The criterion is met. <br /> <br />d. The proposed dwelling will be occupied by a person or persons who produced the <br />commodities which generated the income in subsection (A)(1)(b) of this section; <br /> <br />The applicant states that Gregory Fries, the sole member of GBF LLC and Fries Vineyards, LLC, will be the <br />occupant of the dwelling approved by this application. Gregory Fries’ role(s) in the production of the <br />commodities were stated by the applicant as “overseeing the cultivation, harvesting and sale of the wine grapes.” <br />The criterion is met and it shall be a condition of approval that the dwelling approval shall be exercised only by <br />the farm operator that conducted the farm use which qualified for the dwelling. <br /> <br />8. MCC 17.137.030 (A)(6) requires that all of the property in a tract used for the purposes of establishing a farm <br />dwelling shall be held, sold and conveyed subject to the following covenants, conditions and restrictions: <br /> <br /> It is not lawful to use the property described in this instrument for the construction or siting of a dwelling <br />or to use the acreage of the tract to qualify another tract for the construction or siting of a dwelling. <br /> <br /> These covenants, conditions, and restrictions can be removed only at such time as the property described <br />herein is no longer protected under the statewide planning goals for agricultural and forest lands or the <br />legislature otherwise provides by statute that these covenants, conditions and restrictions may be <br />removed and the authorized representative of the county or counties in which the property subject to <br />these covenants, conditions and restrictions is located executes and records a release of the covenants, <br />conditions and restrictions, consistent with OAR 660-006-0027. <br /> <br />As such, it shall be made a condition of approval that the applicants record a Use of Agriculture/Forest Land for <br />Dwelling Qualification-OAR 660-006-0027 declaratory statement for each of the subject parcels in the tract used <br />to qualify for the dwelling prior to the issuance of building permits for the primary farm dwelling. The parcels <br />shall be considered as one unit of land for land use purposes. <br /> <br />9. MCC 17.137.100 (C) requires that a declaratory statement meeting the requirements outlined under that section be <br />filed, and this serves to notify the applicant and subsequent owners that there are farm or timber operations in the <br />area. The recording of a Farm/Forest declaratory statement shall be made a condition of approval. <br /> <br />10.
