7. According to MCC 117.116.020(B) in order to adjust the special setback standards in the FT zone only the criteria <br />listed in 17.139.070(A) must be met. These include: <br /> <br /> 17.128.050(A) Special siting standards for dwellings near resource zones. <br />1. The location of the home site will have the least impact on nearby or adjoining forest or agricultural <br />lands. <br /> <br />The setbacks will be reduced to the proposed distances to alleviate the building on steep slopes, <br />and away from areas prone to flooding and areas where water pools create wetlands during rain <br />events. This placement allows for a more feasible building site. It will require less site <br />disturbance and grading than the previous location and maintain a 107-foot dwelling setback and <br />70-foot accessory structure setback to the nearest parcel which is currently vacant. This still <br />allows for separation between potential forest and agricultural uses on the adjacent southern <br />parcels. The criterion is met. <br /> <br />2. The location of the home site ensures that adverse impacts on forest operations and accepted farming <br />practices on the tract will be minimized. <br /> <br />The location of this home site will allow for less site disturbance and grading than previously <br />required by the 155-foot setbacks from the previous adjustment case and allows the dwelling to <br />be out of the marsh areas. This will not impact farm or forest practices as it preserves more of the <br />land to be devoted to forest use. The criterion is met <br /> <br />3. The amount of agriculture and forestlands used to site access roads, service corridors, the dwelling <br />and structures is minimized. <br /> <br />As explained above, this location will require the least impact to the site as the reduced setbacks <br />will require less road and infrastructure to be built on the parcel. The criterion is met. <br /> <br />4. The risks associated with wildfire are minimized. <br /> <br /> The dwelling will be required to maintain fuel breaks as well as a fire hazard reduction plan as <br />recommended by the Oregon Department of Forestry and shall meet the fire protection and <br />hazard reductions as listed in MCC 17.138.060 as part of the administrative review which <br />approved the dwelling. AR20-012. The criterion is met. <br /> <br />8.
