I. All visits by suppliers or customers shall occur between the hours of 8:00 a.m. and 8:00 p.m. These <br />limitations do not apply to a bed and breakfast use as defined in MCC 17.110.108. <br /> <br />The applicant indicated in their statement that the business will not be conducted during “quiet hours”, which are <br />the hours between 7am through 10pm per MCC 8.45.080 (G). As such, it is necessary to specify that the operation <br />only occur within the hours of 8am to 8pm. This section shall be made a condition of approval. <br /> <br />J. There shall be no outside storage or display of materials, equipment, or merchandise used in, or <br />produced in connection with, the conditional home occupation. <br /> <br />The applicant is proposing to conduct the home occupation entirely within the accessory shop structures on the <br />property. The criterion is met; however, it shall still be made a condition of approval that the home occupation <br />continuously operate in compliance with this section. <br /> <br />K. Deliveries to or from the dwelling shall not involve a vehicle rated at more than one ton. There shall <br />be no more than one commercial vehicle located on the property in conjunction with the home <br />occupation. <br /> <br />The applicants have not indicated that there will be any commercial vehicles used in the operation of the proposed <br />home occupation. It was also unspecified how deliveries of any parts, tools, or fluids would be delivered to the <br />property on a regular basis, however it is entirely feasible for all reasonably expected parts to be delivered by <br />vehicles compliant with this section. Therefore adherence to this section shall be made a condition of approval, <br />and the continued compliance with this section ensures that the criterion is met. <br /> <br />L. Where a home occupation involves deliveries, one off-street loading space shall be provided. If visits <br />by customers occur, two additional off-street parking spaces shall be provided if the street along the lot <br />frontage does not provide paved area for at least two parallel parking spaces. During normal <br />loading/unloading or customer parking periods the off-street loading and parking spaces shall be <br />reserved exclusively for that use. <br /> <br />The subject property, and specifically the area surrounding the accessory structures proposed for use in the home <br />occupation, is open and graveled as part of the driveway. There is sufficient room for off-street parking and <br />unloading in this area. The criterion is met, but the requirements of this section shall be included in the conditions <br />of approval. <br /> <br />M. The property, dwelling or other buildings shall not be used for assembly or dispatch of employees to <br />other locations. <br /> <br />The proposed automotive repair business will conduct repair services to customer vehicles on the subject property <br />and is not proposing to do dispatch service. Based on this business model the proposal meets the criterion. <br />Continued compliance with this section shall be made a condition of approval. <br /> <br />N. Retail and wholesale sales that do not involve customers coming to the property, such as Internet, <br />telephone or mail order off-site sales, and incidental sales related to the home occupation services being <br />provided are allowed. No other sales are permitted as, or in conjunction with, a home occupation. <br /> <br />The proposal is for a service-based home occupation of automotive repair and is not retail and sales oriented. The <br />applicants were not proposing any sales and all visits by customers would be for the automotive repair services. <br />While this proposal does meet the requirements of this section, it shall be made a condition of approval that all <br />customer visits to the property be by prior appointment only to ensure that any retail sales that occur are incidental <br />to scheduled visits for automobile repair. The criterion is met. <br /> <br />7. Since the property is located in an AR zone, the proposal must also satisfy the compatibility criteria in MCC <br />17.128.040 MCC. Those requirements are: <br /> <br />a. The conditional use as described by the applicant will be in harmony with the purpose and intent of <br />the zone. <br /> <br />The proposed home occupation will be conducted within existing structures on the property and will not <br />necessitate significant modification to the property to execute. The business will not result in permanent
