Public Works Land Development and Engineering Permits (LDEP) requested that the following be included in the <br />land use decision. <br /> <br /> Requirements: <br /> <br />A. Transportation System Development Charges (TSDCs) will be assessed in association with any <br />required Building Change-in-Occupancy permitting from personal to commercial use. <br /> <br /> Marion County Tax Assessor provided comments regarding the tax status of the subject property. <br /> <br /> Marion County Building commented: “If any public persons are to be in any building for business purposes, then a <br />change of occupancy/use permit would be required to be obtained for the building where these transactions or <br />operations with the public are to take place. Plans would be required for application, which the plans would have <br />to identify how accessibility from the parking location to the entrance will be provided, and within the building <br />accessible route. This plan should also identify the location of an accessible restroom and if one is not provided, <br />one will be required whether new or an alteration to an existing restroom. If no public persons are to be present in <br />a building for this business, then this change of occupancy/use permit is not required, as well as accessible <br />provisions and accessible restroom. If any alterations to the existing buildings is anticipated, regardless if the public <br />is present or not, then these alterations may require separate permits be obtained prior to starting this work. <br />Discussion with a building plans examiner is recommended.” <br /> <br /> Marion County Septic provided the following comments: <br /> <br /> Condition of Approval: Authorization is required due to the change of use/proposed home occupation. <br /> <br /> Note: A full business narrative including disposal practices must be submitted with the authorization <br />application. Note that only effluent that is residential waste strength can be permitted at a county level. If <br />any automotive waste is proposed to dispose of the septic system, a WPCF permit through the Department <br />of Environmental Quality will be required. <br /> <br />All other contacted agencies either stated no objections to the proposal or did not provide comments. <br /> <br />6. In order to approve a home occupation on a property in the AR zone the applicant must demonstrate compliance <br />with the specific criteria listed in Section 17.120.075 of the Marion County Code (MCC). These include: <br /> <br />A. The home occupation shall be carried on by the resident or residents of a dwelling on the subject <br />property as a secondary use and may employ no more than two persons (“person” includes volunteer, <br />nonresident employee, partner or any other person). <br /> <br />The person operating the proposed home occupation is Aaron Fouts, who is both owner of the property and <br />resident of the dwelling on the property. The criterion is met. <br /> <br />B. The home occupation shall be continuously conducted in such a manner as not to create any public or <br />private nuisance, including, but not limited to, offensive noise, odors, vibration, fumes, smoke, fire <br />hazard, or electronic, electrical, or electromagnetic interference. In a residential zone noise associated <br />with the home occupation shall not violate Department of Environmental Quality standards or <br />Chapter 8.45 MCC, Noise. <br /> <br />The applicant states that they will take steps to reduce the potential impacts of the proposed business on <br />neighboring properties. They stated the business would not operate during normal quiet hours, that there will be <br />additional insulation added to the existing shop structures to further dampen sound, will aim any additional <br />lighting down and away from neighboring properties. Further, they described how they would regularly dispose of <br />waste fluids (such as oils) and identified a specific storage area in one of the buildings for fluid waste storage. The <br />business is unlikely to create significant electrical or electromagnetic interference in the area based on the scale of <br />operation and the risk of odors, fumes, or smoke is reduced by conducting the operation within the shop <br />structures. <br /> <br />Based on the application, the proposed home occupation can operate in compliance with this section, but it shall <br />also be made a condition of approval that they continuously operate in a manner compliant with this section in
