using a deed that describes current TL 1900, 1901 and 2000 as one parcel (Volume 691, Page 243; September 23, <br />1970). <br /> <br />In February 1976, Russell N. and Aleen B. Wilson transferred an area of land that was a separate parcel from the <br />northern acres by deed to Dana F. Wilson and Russell F. Wilson, DBA, Wilson’s Hatchery. This is currently TL <br />2600 (Reel 37, Page 404; February 19, 1976). <br /> <br />All these transfers by deed occurred before September 1, 1977, the date the Marion County’s current partition and <br />property line adjustment criteria became effective (Ordinance 481). After September 1, 1977, all partitions and <br />property line adjustments were required to be approved by the Marion County Planning Director. <br /> <br />8. Summary of the Findings by Tax Lot: <br /> <br />Tax Account 1900. <br />As of September 1, 1977, tax account 1900 was part of a 7.24 acre parcel of land under Volume 691, Page 243 <br />(September 23, 1970) that includes modern day TL 1900, 1901, and 2000. <br />The configuration was changed in 1987 by partition P87-053 and was first recorded in its proper legal <br />configuration in 2025 by deed Instrument Number 2025-05579 (Feb. 28, 2025). However, on May 29, 2025, <br />Russell F. Wilson and Rebecca K. Wison transferred the parcel to Wilson Property Investments, LLC., using <br />Instrument Number 2025-016219 where they attached the correct legal description and the whole of Instrument <br />Number 2025-05579 with the correct legal perimeter description per P87-053 but added a modified perimeter <br />description that removed the southern approximate one acre. This deed is not considered accurate nor is it the true <br />legal description of the parcel, as it attempts to adjust a property by deed after September 1, 1977. Tax account <br />2000 was first transferred by deed Reel 491, Page 193 on September 25, 1986. <br />Tax lot 1900 is not in the correct legal configuration. The southern 1.03 acres has been truncated without a land <br />use case and is now part of TL 2200. In partition case P87-053 tax lot 1900, 6.93 acres, was partitioned into two <br />pieces, the dwelling on TL 2000 as 2.10 acres (092E18A002000). This parcel has remained in this configuration <br />since then. The remainder of TL 1900 (092E18A001900) was proposed to be a 4.83 acre parcel. The <br />accompanying survey that recorded to complete the partition, Survey 31264, dated February 23, 1988, indicates <br />that TL 1900 is 5.03 acres; this includes approximately 1.03 acres of current TL 2200. This parcel is described in <br />the correct legal description in Instrument Number 2025-05579 dated February 28, 2025 <br />Tax account 1900 was a lawfully created parcel of 5.03 acres, but has since been modified without approval of the <br />Marion County Planning Director. For the purposes of this application, it is considered a legal parcel, the owners <br />should re-record its proper deed description to clear up the incorrect description that was recorded for it. <br />Tax Account 2000. <br />On September 23, 1970, there is a deed Volume 691, Page 243, that describes TL 1900 as approximately 7.24 <br />acres that contains current TL 1900, 2000, and 1901. This parcel was created in 1987 by partition case P87-053 <br />and has remained in its proper configuration since. On September 25, 1986, TL 2000 was sold by Russell F. and <br />Rebecca K. Wilson to Frans J. and Dorthy J. Heijen. This was the configuration before P87-053; Reel 491, Page <br />193 (September 25, 1986). <br />In October 1991 TL 2000 was transferred by Dorothy June Jones, aka, June Williamson, aka, Dorthy J. Heijden to <br />Ricky L. Williamson by deed Reel 894, Page 445 (October 24, 1991). The legal description used in this deed is <br />the legal description created in P87-053. This deed conveyed the property for the first known time using the new <br />perimeter description resulting from the partition in 1987 (P87-053). All subsequent deeds use the same language <br />for the perimeter description. <br />Tax lot 2000 is a lawfully created parcel of 2.10 acres and has remained in its configuration created since the last <br />known land use case with Marion County. <br />Tax Accounts 2200, 2400, 2600 (2201, 2102) <br />As of September 1, 1977, tax lots 2200, 2400, and 2600 were parts of two different parcels. TL 2200 was part of a <br />larger 26 acre parcel described by deed Volume 598, Page 424 (March 18, 1965). While TL 2400 and 2600 were
