The applicant states that they understand this structure may not be occupied as a dwelling unit. This <br />application is the direct result of code enforcement which is in part related to complaints that the <br />second story of a pole barn was being utilized as a dwelling unit. Rather than demolish this area <br />the applicant is seeking these Variance and Adjustment approvals to be able to utilize what is <br />already present for a use that is allowed subject to standards. The applicant attests that only their <br />son who lives offsite and travels for work will occasionally stay at the guest facility on weekends <br />only. The applicant understands and is warned that this permit may be revoked and citations issued <br />if this structure is used as a unpermitted dwelling, or any other guest facility criteria unadjusted by <br />this land use decision are not continuously followed. The applicant’s description of proposed use <br />is consistent with the intent of a guest facility to be utilized infrequently by guests of the property <br />owner/resident. It shall be a continuous condition of approval that this guest facility shall not be <br />utilized as a dwelling unit. <br /> <br />h. The guest facility shall not have an address; and <br /> <br />No address will be issued for this guest facility. <br /> <br />i. A declaratory statement shall be recorded requiring compliance with the standards in this <br /> subsection; <br /> <br />The declaratory statement (Guest Facility Restrictions and Requirements) shall be a condition of <br />approval. <br /> <br />Based on the application submitted, it is possible for a guest facility to be established with the variance to <br />permit its size to be 360-feet larger than standard, and the adjustment to permit its establishment within a <br />structure larger than 600-square feet. The proposed guest facility, if established with all necessary permits <br />from Marion County Building, shall be 960-square feet within a 2,400-square foot pole barn. <br /> <br />10. This decision is being reissued to correct text in findings in section 8. <br /> <br />11. Based on the above findings, the applicants’ proposal meets the criteria for a variance and an adjustment.
