Condition A: On the partition plat, dedicate a 25-foot right-of-way (R/W) half-width along Midway Avenue to the <br />public for roadway purposes. <br /> <br />Nexus for the above Condition is in general accordance with Marion County Code (MCC) 16.33.260 in order to <br />provide sufficient R/W width to construct a minimum level of urban roadway improvement. It is noted that Midway <br />Avenue is predominantly a total 30-foot wide public right-of-way connecting Morgan Avenue to 36th Avenue. This <br />Condition is in keeping with the R/W dedication requirements associated with Lot Line Adjustment/Partitioning <br />Case #95-018 and Partitioning Case #18-031 establishing precedence. It is noted that westbound traffic on Midway <br />is restricted by an agency-placed barricade as mitigation for nearby Target shopping center documented cut -thru <br />traffic. <br />Condition B: Prior to plat approval, acquire an Access Permit, and under the Permit, construct a paved approach <br />centered on the shared access easement. <br />Condition C: Prior to plat approval acquire a permit from MCPW Engineering, and under the permit, pave Midway <br />Avenue with Hot-Mix Asphalt along the property frontage at 20 feet width x 3 inches thickness, including base rock <br />leveling course as determined by the County Inspector. The paving is intended to match-in with similar paving <br />done as required for partitioning at adjacent Endway Place. <br /> <br />Condition D: Prior to plat approval, acquire necessary third-party utility permits, and under a permit from MCPW <br />Engineering, make necessary service lateral extensions to serve the rear parcel. Note that once required road paving <br />has been completed, cutting the newly placed pavement for non-emergency utility work will not be authorized for <br />a period of at least 3 years. <br /> <br />Condition E: Prior to plat approval, Applicant shall design a drainage conveyance system to serve the rear parcel. <br />The system may be constructed concurrently with dwelling construction. There may be an option to connect directly <br />into the East Salem Service District concrete pipe main situated within a public drainage easement over the rear <br />parcel on Endway Place. In addition to a PW Engineering permit for such a connection, a Building Rain Drain <br />Plumbing Permit may also be required. <br />Condition F: Prior to plat approval, record a Road Maintenance Agreement for maintenance of the new shared <br />private lane. <br />7. The resulting parcels shall significantly conform to the site plan submitted with the proposal. Minor variations are <br />permitted upon review and approval by the Planning Director. <br /> <br />8. The parcels shall be addressed as shown on the marked site plan and are as follows: (parcels correspond to those <br />on site plan.) <br />Parcel 1/Lot 1 – 3685 Midway AveNE (existing). <br />Parcel 2/Lot 2 – 3691 Midway Ave NE (proposed). <br /> <br />ADDITIONAL CONDITIONS: Once the approved use is established the following conditions must be continually <br />satisfied: <br />9. After the final Partition plat has been recorded no alteration of property lines shall be permitted without first obtaining <br />approval from the Planning Director. <br />OTHER PERMITS, FEES, AND RESTRICTIONS: This approval does not remove or affect covenants or restrictions <br />imposed on the subject property by deed or other instrument. The proposed use may require permits and/or fees from other <br />local, State or Federal agencies. This decision does not take the place of, or relieve the responsibility for, obtaining other <br />permits or satisfying restrictions or conditions. The applicant is advised of the following: <br />10. Prior to recording the plat, all taxes due must be paid to the Marion County Tax Department (contact the Marion County <br />Tax Department at 503-588-5215 for verification of payments).
