)4 <br /> -q ' <br /> 1 A BILL <br /> BILL NO. 46 FOR ORDINANCE NO. 45-93 <br /> 2 <br /> AN ORDINANCE relating to the designation of property located <br /> 3 <br /> in the 6000 BLOCK OF SUNNYSIDE ROAD S.E. as open space for <br /> 4 <br /> purposes of an application for special assessment. <br /> 5 <br /> WHEREAS, application for Special Assessment of Open Space Land <br /> 6 <br /> under ORS 308 .740 -308 .790 was made for property located in the <br /> 7 <br /> 6000 block of Sunnyside Road S.E. , more fully described in the <br /> 8 <br /> attached Exhibit A; and <br /> 9 <br /> IWHEREAS, the Common Council considered designation of the <br /> 10 <br /> property as open space in a public hearing on June 28, 1993; and <br /> 11 <br /> WHEREAS, the Council having considered the recommendation of <br /> 12 <br /> the Salem Planning Commission and the entire record of the public <br /> 13 <br /> hearing; NOW, THEREFORE <br /> 14 <br /> BE IT ORDAINED BY THE COMMON COUNCIL <br /> 15 <br /> OF THE CITY OF SALEM, OREGON: <br /> 16 <br /> Section 1. Findings . The Common Council hereby adopts as <br /> 17 <br /> findings of fact the staff reports dated June 28, 1993 and July <br /> 18 <br /> 6, 1993 . The Council further finds that the below described <br /> 19 <br /> property qualifies as open space land under ORS 308 . 740 to <br /> 20 <br /> 308 .790 . <br /> 21 <br /> Section 2 . Order.
