property. These main features make the subject parcel suitable enough to meet this specific section. The <br />criterion is met. <br /> <br />(c) The proposed use, as conditioned, will not substantially limit, impair, or preclude the use of surrounding <br />properties for the uses permitted in the applicable zone. <br /> <br /> The proposed use of a dog groomer as a home occupation will be required to comply with the specific <br />criteria listed under MCC 16.32.400 addressed under Finding #6 above. These criteria include conducting <br />the home occupation entirely indoors, prohibiting retail sales involving customers coming to the property, <br />limiting deliveries to the business, and continually conducting the home occupation in a way that does not <br />create a nuisance. All of these criteria, and the continued adherence to these standards, shall be made <br />conditions of approval. Further, customer visits for the services shall also be limited to an appointment <br />only basis. These operating criteria and the related conditions provide guardrails that will allow the <br />business to operate such that it does not substantially limit, impair, or preclude surrounding properties <br />from being used as intended, and allows a mechanism for enforcement should the applicants fail to <br />operate in such a manner. Therefore, the criterion is met. <br /> <br />(d) The proposed use, as conditioned, will not have a significant adverse effect on air or water quality. <br /> <br /> The proposed use as a dog grooming business is limited to being conducted within structures on the <br />property. As such, this reduces the risk of the business impacting air quality in the local area. The <br />property is also within the East Salem Water Service District and is connected to a sewer system. Dog <br />groomers use different shampoos and other chemicals in their business operations which could cause <br />issues with water quality if they were flushed into an onsite septic system, but since the property is <br />connected to sewer this is not an issue. Therefore, it can be reasonably assumed the proposed business <br />will not have a significant adverse impact on air or water quality. The criterion is met. <br /> <br />(e) Adequate public and utility facilities and services to serve the use are available or will be made available <br />prior to establishment of the use. <br /> <br /> As previously mentioned, the property is served by the East Salem Water Service District and is <br />connected to a sewer system, meaning the water and wastewater systems are in place. The property also <br />has frontage on a public road, has power, and is served by the Marion County Sheriff and Marion County <br />No. 1 fire district. All other services are either available or can be made available. Therefore, the criterion <br />is met. <br /> <br />8.
