Marion County Surveyors Office commented: <br /> <br />1. Property line adjustment deed(s) shall be recorded with the Marion County Clerk’s Office. Per ORS <br />92.190 (4) AFTER THE PLAT. <br />2. A re-plat (in the form of a partition plat) is required, due to the adjustment or elimination of a partition <br />plat parcel line or subdivision lot line. <br />3. Must be platted per ORS 92.050/055, and the plat submitted for review. <br />4. Checking fee and recording fees required. <br />5. A current or updated title report must be submitted at the time of review. <br /> <br />Marion County Building commented: “It appears structures exist near the proposed property lines that may be <br />under the authority of the state building code. It is recommended the new property lines be established at least 3 <br />feet away from existing residential structures and at least 10 feet away from existing commercial use structures (if <br />present). Permit(s) are required to be obtained prior to the development of structures and/or utilities installation <br />on private property.” <br /> <br />Marion County Septic: <br /> Specific Conditions of Approval: <br />14822 Jefferson Hwy 99E SE, Jefferson – The existing septic systems will need to be located and Existing System <br />Evaluation Reports submitted to Building Inspection. A Site Evaluation will be required for the future septic <br />replacement area for the mobile home park. <br /> <br />DEQ comment on PLA 26-004: <br />Facilities with a total design capacity greater than 2,500 gallons per day are required to operate their septic <br />system(s) under a DEQ issued Water Pollution Control Facilities permit when a system major repair or major <br />alteration is necessary. Jefferson Mobile Park LLC must secure a full system replacement area. <br /> <br />15002 Jefferson Hwy 99E SE, Jefferson – Septic has no comment regarding this property as it is getting larger as <br />part of the proposed property line adjustment. <br /> <br />All other contacted agencies either failed to comment or stated no objection to proposal. <br /> <br />6. No specific criteria exist for property line adjustments in the AR zone. MCC 17.128.070 requires a minimum lot <br />size of two acres, except when a numerical suffix has been applied. Therefore, in this AR zone, the minimum lot <br />size is two acres. When a property line adjustment proposes to alter non-conforming parcels, the proposed <br />configuration must not result in additional non-conformance. <br /> <br /> Both existing lots are above the minimum parcel size of 2.0-acres for the AR zone. The proposed property line <br />adjustment transfer the vacant land occupied by the mobile home park to the church. No lot or parcel will be <br />brought below 2.0-acres as a result of the proposed adjustment; however it shall be made a condition of approval <br />that all resultant parcels be at least 2.0-acres in size. <br /> <br />7. Under MCC 17.172.120(E) Property line adjustment deeds shall be recorded with the Marion County clerk’s <br />office prior to submitting the property line adjustment survey if a survey is required. Deed recording reference <br />numbers shall be noted on the required survey. <br /> <br />8.
