Marion County Building Inspection commented: “Electrical permits would be required to be obtained prior to <br />system alteration and/or installation, if proposed. Plumbing permit would also be required for any potable water <br />system alteration or installation. If this plumbing system alteration or installation is upstream of the water <br />treatment processing system, this water is not considered potable, thus a plumbing permit is not required <br />according to the 2023 OPSC and the Marion County Plumbing Inspector.” <br /> <br />Oregon Department of State Lands (DSL) requested inclusion of a general response which states in part: <br />“A DSL removal-fill permit may be required for projects that add, remove, or move material to wetlands, streams, <br />and other waters. In addition, DSL proprietary authorizations may be required for projects in Oregon-owned <br />Waterways.” The rest of this comment is included in the case file. <br /> <br /> All other contacted agencies either failed to comment or stated no objection to the proposal. <br /> <br />6. The purpose of the Floodplain Overlay Zone is to promote public health, safety and general welfare to minimize <br />public and private losses due to flood conditions. In order to ensure that the development is reasonably safe from <br />flooding, the County requires the development to comply with the criteria and standards listed in Section <br />17.178.050 and 17.178.060 of the Marion County Code (MCC). <br /> <br />7. The property is in Marion County, but FEMA includes it in a Floodplain Insurance Rate Map (FIRM) for Linn <br />County. This is primarily important to note because the elevations measured in Marion County utilize the <br />NVGD1929 vertical datum and Linn County uses the NAVD1988 vertical datum. The Linn County Flood <br />Insurance Rate Map #41043C0070G indicates that the development site is in an AE zone. Base Flood Elevations <br />(BFE) are provided in this zone but vary across the subject parcel. Across the area in which the wells and <br />associated facilities will be placed the BFE varies from 472.1’ to 483.5’ NAVD1988, or 468.7’ to 480.1’ NGVD <br />1929 according to FEMA data provided on FIRMs #41043C0070G & #417047C0725G. <br /> <br />8. Marion County Code 17.178.050 requires the following prior to any development in the Special Flood Hazard <br />Area (SFHA): <br /> <br />(C) Prior to obtaining a building permit the owner shall be required to sign and record in the deed records <br />for the county a declaratory statement binding the landowner, and the landowner’s successors in interest, <br />acknowledging that the property and the approved development are located in a floodplain. <br /> <br /> The recording of this declaratory statement has been a condition of approval in the past. The most <br />recently recorded Floodplain Declaratory Statement for Geren Island was a condition of approval for <br />FP16-005. That statement is recorded in Reel 3849, Page 24, in the Book of Land Records for Marion <br />County. The criterion is met. <br /> <br />(D) Prior to obtaining a building permit, commencing development or placing fill in the floodplain, the <br />applicant shall submit a certification from a registered civil engineer demonstrating that a development <br />or fill will not result in an increase in floodplain area on other properties and will not result in an <br />increase in erosive velocity of the stream that may cause channel scouring or reduce slope stability <br />downstream of the development or fill. <br /> <br />The City of Salem provided a no-rise certificate and associated analysis performed by WEST Consultants, <br />Inc. The included analysis confirms that the proposed improvements will not increase flood levels on <br />other properties, nor will they increase the erosive velocity of the stream. The criterion is met. <br /> <br />9. Marion County Code 17.178.060 requires flood protection standards for development in the SFHA, the following <br />standard applies to the proposal: <br /> <br /> (D). Anchoring. <br /> 1. All new construction and substantial improvements shall be anchored to prevent flotation, <br /> collapse or lateral movement of the structure resulting from hydrodynamic and hydrostatic <br /> loads, including the effects of buoyancy. <br /> <br /> This criterion applies to the above ground piping, and the applicant has provided construction <br /> drawings indicating proper anchoring of all pipe. This shall be a condition of approval. <br /> <br /> (E) Construction Materials and Methods.
