of 100 feet to the south property line for the proposed shop/office structure identified on the applicant’s site plan. The <br />volunteered proposal of a 100-foot setback for the shop/office structure by the applicant is an appropriate mitigation <br />strategy for the noise generated by the use. Staff agrees that this is a sufficient setback to help mitigate noise from <br />impacting the neighboring dwelling and will make this setback a condition of approval. Additionally, a vegetative <br />buffer of at least 8 feet in height along the south property line shall be required as a condition of approval to mitigate <br />any noise from equipment/vehicle parking areas that may be located closer to the property line than the shop/office <br />structure. Finally, a limit on how late the noise generating activities are conducted will serve as a protection for all <br />surrounding residences, and shall be made a condition of approval. <br /> <br />The convenience store to the east is unlikely to be significantly impacted by the proposal as it already generates loud <br />traffic from delivery trucks as well as from its customer base. The church to the west will only be occupied during <br />normal business hours and likely not every day. The proposed commercial use is unlikely to disturb normal church <br />operations in a significant adverse way through reasonably assumed noise generation. <br />Therefore, with the application of appropriate conditions, the proposed use can be operated such that it doesn’t <br />generate any significant adverse impacts on nearby land uses. The criterion is met. <br /> <br />5. The use will not have a significant adverse impact on potential water impoundments identified in the <br />Comprehensive Plan, and not create significant conflicts with operations included in the Comprehensive Plan <br />inventory of significant mineral and aggregate sites. <br /> <br />There are no nearby water impoundments or mineral and aggregate sites that would be impacted by the proposal. <br />The criterion is met. <br /> <br />9.
