Attention Property Owner: A land use proposal has been submitted for property near where you live or near property you own <br />elsewhere. State law requires that the county notify property owners within a certain distance from this property. The proposal and <br />address of the property is described in the "Application" section below. The decision in this case does not directly affect the zoning or <br />use of your property. If you object to the decision, refer to the "Appeal" section. If you have questions, contact the staff person listed <br />at the end of this report. <br /> <br />NOTICE OF DECISION <br />CONDITIONAL USE CASE NO. 25-042 <br /> <br />APPLICATION: Application of Butteville Commercial Property LLC for a conditional use permit to operate an <br />excavation business as a commercial use in conjunction with agriculture in an EFU (Exclusive Farm Use) zone located in <br />the 18000 block of Butteville Rd NE, Aurora (T4S; R2W; Section 36; Tax lot 100). <br /> <br />DECISION: The Planning Director for Marion County has APPROVED the above-described Conditional Use applica- <br />tion subject to certain conditions. <br /> <br />EXPIRATION DATE: This conditional use permit is valid only when exercised by December 18th, 2027. The effective <br />period may be extended for an additional year subject to approval of an extension (form available from the Planning <br />Division). Additional extensions may not be granted if the regulations under which this decision was granted have <br />changed since the original approval. <br /> <br />WARNING: A decision approving the proposal is for land use purposes only. Due to septic, well, and drain field <br />replacement areas, these parcels may not be able to support the proposal. To be sure the subject property can <br />accommodate the proposed use the applicant should contact the Building Inspection Division, (503) 588-5147. <br /> <br />This decision does not include approval of a building permit. <br /> <br />CONDITIONS: The following conditions must be met before a building permit can be obtained or the approved use <br />established: <br /> <br />1. The applicant shall obtain all required permits from the Marion County Building Inspection Division. <br /> <br />• Per Marion County Septic; An authorization is required, and shall be obtained, for the change of use of <br />the property. If no system currently exists or another system is proposed for this use, a site evaluation <br />followed by a construction-installation permit is required. <br /> <br />2. Excavation services for non-farm related customers and projects shall remain below 25% of the total commercial <br />operations of the business. In the future, the Planning Division may request a review of service receipts to ensure <br />compliance with this condition. <br /> <br />3. The applicant shall sign and submit a Farm/Forest Declaratory Statement to the Planning Division. This <br />statement shall be recorded by the applicant with the Marion County Clerk after it has been reviewed and signed <br />by the Planning Director. <br /> <br />4. Expansion of the commercial activity beyond the extent submitted in the proposal may require a new conditional <br />use permit. <br /> <br />5. Development of the site for the proposed use shall comply with the property development standards under <br />Chapter 17 of the Marion County Code, including parking requirements. <br /> <br />6. The subject parcel shall be assigned the address 9394 Broadacres Rd NE, Aurora. <br /> <br />7. The proposed shop and office structures shall maintain a 100-foot setback from the southern property line. <br />Parking of vehicles and storage of materials shall maintain a 50-foot setback from the southern property line. <br />
