Therefore, with a condition of approval requiring a declaratory statement providing an enforcement mechanism, the <br />criterion is met. <br /> <br />2. Adequate fire protection and other rural services are, or will be, available when the use is established. <br /> <br />The subject parcel is within the Silverton Fire District and Marion County Sheriff’s area of service, so fire protection <br />and emergency response services are available. The parcel is already developed with a dwelling that has an approved <br />septic system and water source and there is electricity available on the property as well. As such, necessary rural <br />services are available or could be made available at the site for an RV. The criterion is met. <br /> <br />3. The use will not have a significant adverse impact on watersheds, groundwater, fish and wildlife habitat, soil <br />and slope stability, air and water quality. <br /> <br />The applicant is proposing to use an RV as a temporary dwelling for the purposes of taking care of an individual with <br />a medical hardship. Typically, an EFU parcel can have someone stay in an RV for up to 120 days in a calendar year <br />and an unoccupied RV can be parked on the parcel year round. The only fundamental difference this use has that <br />could impact air and water quality is the disposal of human waste. So long as a sanitary waste disposal system is in <br />place, the RV should not have any significant adverse impacts on air and water quality. Marion County Septic <br />provided comments requiring a septic authorization as a condition of approval for this hardship, so the applicants will <br />be able to meet this condition by completing all required conditions of approval. Therefore, the criterion is met. <br /> <br />4. Any noise associated with the use will not have a significant adverse impact on nearby land uses. <br /> <br />The applicant is proposing to use an RV as a temporary residence. The RV is unlikely to generate noise beyond <br />typical residential levels, and theoretically could generate less noise than a manufactured home (the alternative option <br />for a medical hardship dwelling). The use will not have a significant adverse impact on nearby land uses. The criterion <br />is met. <br /> <br />5. The use will not have a significant adverse impact on potential water impoundments identified in the <br />Comprehensive Plan, and not create significant conflicts with operations included in the Comprehensive Plan <br />inventory of significant mineral and aggregate sites. <br /> <br />While the subject parcel is partially within the floodplain of the Pudding River, the river itself in not a “water <br />impoundment” and as such there are no water impoundments near the subject parcel. However, the Pudding River <br />potentially connects to other impoundments farther from the site and contamination in the river could adversely <br />impact other water impoundments. However, a single RV used as a temporary dwelling cannot be reasonably <br />expected to cause a significant adverse impact on the river or any connected water impoundments so long as the <br />waste disposal method is properly done. The authorization required by Marion County Septic, as well as recurring <br />5 year authorization renewals, will mitigate the chance of adverse impacts as a result of the waste syst em for the <br />hardship. Therefore, the criterion is met. <br /> <br />11.
