The property was the subject of land use case AR25-017, which established the right to replace the residence this <br />floodplain permit is required for. Therefore, the subject property is considered legal for land use purposes. <br /> <br />3. Surrounding lands are zoned SA with most being almost entirely within the 100-year floodplain of Mill Creek. <br />Most surrounding properties contain homesites. The surrounding properties approximately 1000 feet northwest lie <br />within the Turner Urban Growth Boundary. <br /> <br />4. Soil # % of Parcel SCS Soil Class High Value? <br /> Clackamas gravelly loam 100% 3 Yes <br /> <br />5. The applicant(s) propose to place a dwelling within the 100-year floodplain of Mill Creek. The home will be <br />elevated a minimum of 2 feet above the BFE. An elevation certificate and Endangered Species Act Compliance <br />Data were provided with the application. Additional elevation certificates will be required. <br /> <br />6. Various government agencies were contacted with opportunities to provide comment. <br /> <br />Marion County Building Inspection commented: “Permit(s) are required to be obtained prior to development of <br />structures and/or utilities installation on private property. The design and construction provisions of 2023 ORSC <br />R322 Flood-Resistant Construction may be required to be applied if the proposed dwelling or other structure(s) <br />are determined by the floodplain administrator to be within the floodplain, in addition to the other provisions of <br />the 2023 ORSC.” <br /> <br /> Public Works Land Development and Engineering Permits (LDEP) commented that the comments in AR25-017 <br />will apply to this floodplain permit. Those comments are: <br /> <br /> ENGINEERING REQUIREMENTS <br /> <br />A. Transportation System Development Charges (SDCs) & Parks fee will be assessed upon application for building <br />permits for the new dwelling. Credit for the prior dwelling is not able to be afforded since the replacement <br />application date is more than one-year beyond the fire destroy date. <br /> <br />B. Utility extension work in the public right-of-way requires permits from PW Engineering. <br /> <br />Turner Fire District commented: <br /> <br />Turner Fire District has previously responded to Marion County Planning (John Speckman); refer to our email dated <br />July 23rd, 2025 regarding the previous Request for Comment Administrative Review 25-017. We also responded <br />in an email dated August 27th, 2025 (copy emailed to Marion County Building) to a request by the applicant (Roman <br />Burykin). Turner Fire District’s responded, “Based on our telephone conversation today including my review of <br />the site plan for the residence, the Oregon Fire Code requirements for both fire apparatus access and for fire <br />protection water supplies are approved without any corrections being required.” Turner Fire District has no <br />additional responses at this time. Please contact us if there is any further information needed regarding this <br />location.” <br /> <br />All other contacted agencies failed to comment or stated no objection to proposal. <br /> <br />7. The purpose of the Floodplain Overlay Zone is to promote public health, safety and general welfare to minimize <br />public and private losses due to flood conditions. The criteria and standards which must be satisfied are listed in <br />Section 17.178.060 of the Marion County Code (MCC). <br /> <br />8. Flood Insurance Rate Map #41047C0683H and LOMA #24-10-0096A indicates that the floodplain elevation is <br />approximately 296.0 feet above mean sea level (MSL). LOMA #23-10-0848A indicates BFE of 295.8. <br /> <br />9. MCC 17.178.050 (B-E) requires prior to any development in the floodplain: <br /> <br />B. When base flood elevation data and floodway data have not been provided in accordance with <br />MCC 17.178.030, the applicant, with the assistance of the floodplain administrator, shall obtain and <br />reasonably utilize any base flood elevation data or evidence available from a federal, state or other source in <br />order to determine compliance with the flood protection standards. If data are insufficient, the floodplain <br />administrator may require that the applicant provide data derived by standard engineering methods. <br />
