4. The following table depicts the soil composition on the property and its capacity to produce wood fiber. <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br /> <br />5. The applicant is proposing to establish a template test forest dwelling in the southwestern corner of the subject <br />property. <br /> <br />6. Various agencies were contacted about the proposal and given an opportunity to comment. <br /> <br /> Marion County Building Inspection commented: “No Building Inspection concerns. Permit(s) are required to be <br />obtained prior to development of structure(s) and/or utilities installation on private property.” <br /> <br /> Marion County Septic Inspection commented: “A site evaluation is required to establish septic viability and <br />establish minimum requirements for a system.” <br /> <br /> Oregon Department of Fish and Wildlife submitted comments in review of the revised big game habitat assessment <br />provided by Turnstone Environmental. Those comments are included in full in the case file. In summary, ODFW <br />stated that this area is within the Santiam Wildlife Management Unit (WMU) and is known to contain relatively <br />large heads of elk in the forested areas around Silver Creek and the agricultural land immediately west of this area. <br />They point out that the area around the subject parcel is within the boundary of the general season antlerless elk <br />damage tag due to the high volume of damage complaints received regarding the herd(s) use of that area. ODFW <br />explains that the clearcuts in areas around the Jeff Creek Corridor provide import food sources to both deer and elk, <br />who seek out early successional habitat for nutritionally rich grazing lands. The mature forest on the other hand <br />may provide shelter for big game, but is less productive as forage area. ODFW suggests that one site visit is not <br />adequate to determine whether Elk use the property. However, given the scale of the project, ODFW suggests that <br />the potential impact to the elk herd(s) in the area will be quite low. <br /> <br />All other contacted agencies either failed to comment or stated no objection to the proposal. <br /> <br />7. In order to place a dwelling in the FT zone, it must first be determined whether predominate use of the property <br />on January 1, 1993 was for forest land or farm land. In this instance, aerial photographs indicate the property was <br />predominantly used as forest land on January 1, 1993. <br /> <br />According to Chapter 17.139.030(B) of the Marion County Code (MCC) a single-family dwelling subject to the <br />special use and siting requirements in MCC 17.139.070 may be allowed provided: <br /> <br />(1) The tract on which the dwelling will be sited does not include a dwelling. “Tract” means all contiguous <br />lands in the same ownership. A tract shall not be considered to consist of less than the required acreage <br />because it is crossed by a public road or waterway. <br /> <br /> This land was formerly part of a larger tract with 071E35C000500, but that parcel was transferred in <br />2018. The property technically consists of two legal parcels divided by a forest road running north and <br />south across the approximate middle of the property. Neither of these parcels have a dwelling. The <br />criterion is met. <br /> <br /> (2) If the lot or parcel on which the dwelling will be sited was part of a tract on January 1, 2019, no dwelling <br />existed on the tract on that date, and no dwelling exists or has been approved on another lot or parcel <br />that was part of the tract. The other lots or parcels in the tract cannot be used to justify another forest <br />dwelling.
